Dear Tim and Kristen Risser,
Community Development staff have reviewed the application to Install rock romp and for ordinary
maintenance and repair of an accessory structure (driveway restoration in a limited area that eroded
during reconstruction of principal structure). The request has been conditionally approved based on the
application submission and the following findings. Please seethe enclosed site plan to reference the
general erosion control and grading notes.
• A complete application was submitted on November 12, 2019 (updated site plans provided). A
complete addendum application for development within the Floodplain Overlay Distant was
submitted on November 15, 2019.
• Stormwater management plans and erosion and sediment control plans have been submitted that
meet Wisconsin Department of Natural Resources Technical Standards and meet the standards set
forth in the Lower St Croix Rlverway Overlay District Section 17 36 H ], as per LUP-2017-040 for
reconstruction the Principal Structure (condition 02 and 03). As these plans were not Implemented,
this will bea condition of this permit to follow through with move conditions
• Vegetation removal (trees) Is not a part of this permit
• Ordinary Maintenance and Repair will Involve adding class limestone gravel over the existing
driveway and limestone riprap to border the driveway, this will not retain, and Is not considered
structural erosion control.
• Rack riprap Is necessary to prevent additional erosion In floodproneareas The riprap will be
Installed above the Ordinary High Water Mark (680 o') and at/below the Regional Flood Elevation
for the St. Croix River (692My therefore the addl0onal permit Is required. The rock riprap will be
approximately 85' and will align with neighboring properties with existing riprap.
• Restoration of the driveway will occur in close proximity to the Town public righM1of-way. Restoration
will involve repairs tothe existing driveway, it will not Involve expansion or construction of a retaining
wall
Based on these findings, approval of the Land Use Permit is subject to the following conditions:
1. Acopy of the DN R Permit for riprap along the shoreline shall be submitted prior to beginning this prject.

2. Approval from the Town of Troy, if necessary, is required prior to driveway restoration near the public
right-of-way.
3. Notification prior tothe beginning of each project is required, the project timeline and scope of workwill
be discussed to determine if an onslte Inspection is necessary. Please contact me directly; my contact
'information Is listed below.
4. Installation of the prepared smnn water infiltration areas is requiretl.
5 All standards per Chapter 17.36IT6.a 1p6)apply (enclosed copy of this section reference). Including the
requirement to plant deep-rooted, native vegetation along the rlprap to help stabilize It, screen IL and
enhance wildlife habitat.
6 The rlprap near the recovery will not involve land disturbance and/or construction of a retaining wall.
]. St Croix County staff reserve the right to require sediment and erosion control measures If found
necessary due to site-speClLc concerns.
8. An affidavit shall be required describing the approved stormwater management erosion and sediment
control and maintenance requirements within 30 days after constructIon is completed pursuant to
Chapter 17 36 H ]g to ensure the devices continue to serve their purpose of preventing stormwaterirom
leaving the property.
9. The property owner shall submit a copy of the affidav¢along with an as- built drawing and photos of the
retold.
10, A post -construction Inspection is required to close out the permit It Is the applicant's responsibility to
schedule this appointment, please contact (715) 386-4680 to schedule.
11. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and
approvald) prior to land disturbance activity.
12. Failure to comply with the teens or conditions above may result In the revocation of this permit bythe
Zoning Administrator according to Chapter 17 36.
This approval Is subject to the conditions listed above; it does not allow for any additional construction,
structures, or buildings beyond the limits of this request. Your information will remain on file at the St.
Croix County Community Development Department suite. It is your responsibility to ensure compliance
with any other local, state, or federal permitting or regulations, including contacting the Town of Troy to
Inquire if additional permissions are required- This permit Is valid for one year, with the passibility of up
BY two (2) six-month extensions If the applicant submits the appropriate permit extension fee and
documentation to the Zoning Administrator. Ampy of the Land Use Permit placard should be submitted
to the local Building Inspector forthe town used application forthe building permit The orange placard
must be posted on thejob-she and visible from public view.

3) Any vegetation that is removed is replaced with native vegetation.
4) Filling and grading activities are designed and implemented in a manner to
erosion, sedimentation, tree damage, and impairment of fish and
wwaurehit
5) WDNR Storm water Construction Technical Standards are implemented_
b. Filling and grading in the areas described in § 1736 F 3 a 4}6 are allowed by
conditional use permit if the fallowing standards are met:
I) All standards under a. above are met.
2) The property owner shall submit a are= water management and erosion and
sediment control plan per § 19.36 H.7.
6. ROCK RIPRAP AND SHORELAND PROTECTION
a. Rack ripmp within a slope preservation zone And in the CHWM setback area is allowed
with a land use permit if the Zoning Administrator determines that ripmp is necessary
to prevent erosion in flood -prone areas, and if all of the following standards are met.
1 Either a State permit is granted for the riprap or stammry criteria or administrative
rate standards are met and a State permit is not required for riprap_
2) The rock riprap is designed in accordance with the WI TUTU Section IV and Any
subsequent revisions to USDA standards, or approved by the Land and Water
Conservation Department
3) Existing vegetation on the shoreline and in the water is maintained as much as
possible withom disturbance.
4) All bare soil on the slope above the riprap shall be stabilized with a native seed
mix, native Vegetation, or mulch.
5) Deep-rooted native vegetation shall be planted among the riprap to help stabilize
it, screen it, and enhance wildlife habitat.
6) The property owner shall be responsible for maintaining the npmp as follows-
a) Upon the first rainfall following installation of the riprap, an inspection shall
be made
b) Thereafter, riprapped areas shall be checked following large storms or Floods,
especially those that are near or exceed the aorta frequency used in the
design Displaced riprap should be removed from its downstream location and
w berme placed according to the specifications above.
b. The property owner shall execute and record an affidavit describing the approved riprap
and maintenance requirements with the County Register of Deeds within 30 days after
construction is completed.
17 The affidavit shall alert subsequent purchasers of the land of the maintenance
requirements of the riprap.
2) The property owner shall submit a copy of the affidavit along with an as -built
drawing and photos of the riprep to the Zoning Administrator
Z STORM WATER MANAGEMENT AND EROSION AND SEDIMENT CONTROL PLANS
Storm water management and erosion and sediment control plans shall be required to
reduce mnoff and sedimentation onto adjacent properties, down steep slopes, and into
the dyer or other drainage ways for all of the following.
I) Construction or modification of principal structures.
2) Accessory strucm®s greater than 100 square feet.
3) Filling or grading allowed by conditional use permit.
