Because construction of said office building was initiated prior to obtaining approvals and permits, the structure is currently in violation of Zoning Code 17.18 Commercial District (1) Special Exceptions, which requires every new use to obtain a special exception permit. In addition, the proposed new POWTS will have to be located so that it can meet all required setbacks in Comm 83.43 after Lot 2 is divided.
