Committee members agreed to postpone the viewing of the Cudd property until the DNR Forester and the Land Conservation staff can attend. The viewing will be rescheduled by Tom Nelson. Motion by Hense seconded by Luckey to approve the agenda. Motion carried. Minutes/December Meeting Date Motion by Hense, seconded by Luckey to adopt the minutes as amended by Luckey. Motion carried. The December meeting has been scheduled for Friday, December 20, 1996. Meeting will start at 8:30 a.m. and will end by 1 p.m. Staff should keep agenda items very short. ZONING BUSINESS Minors Minors were reviewed by Assistant Zoning Administrator Mary Jenkins. Please see attached attachments. Major: Green Acres Country Estates First Addition Final Plat Section 15, Town of Somerset, 11 lots on 37.04 acres. Staff recommends conditional approval with minor map changes to be completed. Motion by Luckey, seconded by Menter to conditionally approve per staff recommendations. Motion carried. Bills, Invoices and Revenue Report Committee members reviewed the Zoning Department revenue report. Motion by Hense, seconded by Menter to approve the October bills. Motion carried. Violations & Citations Zoning Administrator Tom Nelson reviewed violation citations to Terry Brown, Herman Heinbuch and Dean Gehrman. No action necessary. Rezonements Bonnie Richert rezoning hearing scheduled for Wednesday, January 8th at the St. Joseph Town Hall, viewing at 7:00 p.m. and hearing at 7:30 p.m. The Frank Keith Boardman rezoning hearing is scheduled for Wednesday, December 18th. F000dplain Mapping - Glen Hills Watershed Nelson reported that the proposed date for a hearing on the floodplain map needs to be rescheduled due to a conflict with the hall. Hearing rescheduled for Wednesday, January 15th at the Glenwood Town Hall at 8 p.m. Subdivision Ordinance Amendment Charles Cook of Continental Development Corporation, has submitted a written request to amend the subdivision ordinance to allow the use of asphalt curbed road design as an alternative to the open ditch road design. His justifications include a more desirable aesthetic residential setting and the design facilitates underground catch basins and storm pipes to collect storm water run-off thereby eliminating soil erosion concerns at the road shoulders and reducing maintenance in these areas. Hense stated that the Town of Troy has been dealing with this issue for several weeks and he would like to have Cook provide an overview of his plans for the Committee. Cook reviewed his application and provided additional handouts. He hopes to use this design in the Ruemmele subdivision in Troy. He pointed out that this design has been used in Ham Lake, Minn., with no curb failure due to snow plowing. Hense reported that the Town of Troy has given preliminary approval of the asphalt curbing design. Discussion on using asphalt versus concrete for the curbing. Cook reported that it will cost approximately $220,000 more to create concrete curbing versus asphalt curbing in the Ruemmele subdivision. Cook feels that the asphalt is more cost-effective and appropriate in the rural setting. Cook is interested in knowing whether this is likely to be allowed because he plans on submitting a preliminary plat in January and will need to have road design completed as part of the plat. Surveyor Technician Ryan Dahlke provided Committee members with a copy of a letter from Highway Commissioner Dan Fedderly covering his concerns about the proposed changes to the subdivision ordinance. Committee members felt further discussion should be held on this before setting up a hearing date. A special meeting will be held on Thursday, December 12th after the Steering Committee meeting. Towns should be sent notice of the December 12th meeting so they can attend and express concerns. The Committee requested that representatives from the Highway, Land Conservation and Corporation Counsel departments attend the December 12th meeting. The amendment should also be on the agenda for December 20th committee meeting. Riverway Bluffline Prior to the meeting, Nelson and Corporation Counsel Greg Timmerman sent memos to the Committee members regarding the proposed amendments to the Zoning Ordinance Section 17.36 Lower St. Croix Riverway District. Discussion on the diagrams. Nelson recommended eliminating some diagrams. Luckey stated that she feels they should be titled and referenced in the text so that the diagrams relate to the text. Timmerman agreed indicating that the text should state that the diagrams illustrate the text. Committee instructed Timmerman to revise the proposed amendments according to the discussion. Discussion on the legal boundaries of the Riverway District. The legal descriptions of the boundaries were removed as part of the amendments. The legal description of the riverway district should be contained in the master plan for the riverway district from the Minnesota -Wisconsin Boundary Area Commission. Nelson's draft copy of the final plan does not have an explanation of how the lines were derived. K For the last ten years the Zoning Department staff have avoided using the legal description in the Zoning language because they do not feel they are accurate. Instead they have used the maps which were provided by the MN -WI Boundary Commission. The maps have recently been compiled and revised by the Planning Department to provide greater accuracy. The Zoning staff is not sure that the source maps are totally accurate. Jim Harrison from the MN -WI Boundary Commission explained that the Riverway District boundary is defined in the National Park Service Master Plan. The Riverway boundary definition for the Master Plan was updated in 1982 and in 1984; only the 1982 update affects St. Croix County. A copy of the 1982 boundary description, as published in the Federal Register, will be provided to Nelson for use in updating the County's maps and amending the ordinance. The Master Plan is now being updated and should clarify any remaining uncertainties about the official boundary. Committee instructed Timmerman and Nelson to incorporate and reference these documents where appropriate in the revisions to the Zoning Ordinance Riverway District. Also the Zoning and Planning Department staff will use these documents to correct County zoning and riverway district maps. Staff will complete all revisions to the amendments to the Riverway District, Section 17.36 and all map revisions for a final review by the Committee at a special meeting on Friday, December 6th at 12:00 p.m. (time later changed to 10 a.m.) at the Government Center. Hearing on the ordinance amendments is set for January 6th at 10 a.m. at the Government Center. Lake Mallalieu Dam The Zoning Department's budget for the Lake Mallalieu Dam is used for annual maintenance. Some major engineering and resurfacing was done on the Lake Mallalieu Dam this past summer. The County is responsible for 50 percent of the cost of maintenance. The nonlapsing fund for repair of the dam was eliminated several years ago when it was decided to utilize the contingency fund if necessary. Cost to the County, as billed by the City of Hudson is $16,240.93. Attachments to the bill have been filed by Administration and were not available for review. Motion by Hense, seconded by Luckey to defer action on the Lake Mallalieu Dam bill until an itemized bill is available for review. Motion carried. Viewing of Cudd Property Violation Discussion on the whether or not viewing the property would be beneficial at this time of year. Committee members decided to view photographs and a videotape of the tree cutting violation in the Salishan development owned by Steve and Jeff Cudd when they are available. Due to a severe storm this past spring there was extensive tree damage to the property. Nelson, with DNR Forester Kathy Nelson, met with the owners and worked out a tree removal and replanting program. The trees were removed. However, a skid loader was used which caused damage and created "paths" through ravines, all on areas well over 12 percent slope, likely 20 percent slope. Hense said he is concerned about lack of erosion control to prevent damage to the property owners below the development. He asked if this is a violation of the ordinance? Regardless of how the paths were created they will cause some major erosion problems next spring. There is concern by the neighbors that additional trees were cut to open up the view. Nelson reported that Dan Koich, DNR, feels it will be very hard to prosecute a violation because there is no way to know which trees were supposed to be cut and which were not. Nelson reported that some of the lots in this development have been sold and some of the new owners are cutting down trees that they should not. It is possible to cite one homeowner where there are photos proving that trees have been cut. Hense asked that the owners of the lots and property be asked to agree in writing to restore the ravines, replant the trees, agree no motorized vehicles will be allowed on the "paths" and take erosion control measures. Nelson stated that the Cudds have agreed to replant the grass but want to utilize their all -terrain vehicles to drive up and down the ravines for woodland management. However, there is not enough woodland to justify this request. Seedlings can be planted but it will take years for them to restore the view. It is difficult to bring in larger trees because the equipment necessary to plant them may do more damage. Shallow bedrock would also affect the survival rate of the trees. Luckey asked if the ordinance gives the authority to require that the trees will be replaced? Yes the ordinance does give that authority. Hense asked if the building permit could be held up until someone came into compliance after violating the ordinance. He is concerned because he has constituents who feel that they have obeyed the ordinance and not cut trees for years. They are angry that these people are allowed to get away with these activities. People will pay minimal fines to get away with what they want but they will not put up with inconveniences. Timmerman stated that they can make the fines significant but only if violations are issued and the violations are brought to court. It is possible to hold up the building permit until reasonable accommodation has been made to bring people into conformance with the Riverway District. Raymond stated his concern that a precedent is being set and asked how to send the right message that this is not acceptable. Discussion. Committee instructed Nelson to issue a citation and a violation on unauthorized tree cutting and filling and grading to all involved property owners. The citations and violations are to be issued within one week. The property owners will be asked to create a compliance plan to correct the problems. If they do not comply, the matter is to be turned over to Corporation Counsel for prosecution. Lunch Recess Committee recessed for lunch at 12:00 p.m. Committee reconvened at 1:20 p.m. PARK BUSINESS Park Bills & Invoices Parks Director Joe Grant passed out a list of the October/November bills. Motion by Hense, seconded by Luckey to approve the bills. Motion carried. Park Manager's Report Grant attended the Wisconsin Park and Recreation Association Convention recently. He talked with DNR people about trail systems and specifically dealing with bike and horse conflicts. He also attended a session on park planning which will be helpful on the Perch Lake project and obtaining public input. He obtained information on firms interested in doing a park master plan. Boot Camp workers have done brushing at the Glen Hills dams, at Glen Hills Park and they placed the 0 riprap on the Woodville Trail box culvert. DNR planted trout at Glen Hills. There have been several meetings of the Snowmobile Association. The grooming contract has been completed. They are ready for the snowmobile season. Pine Lake Aerators There were problems with the Pine Lake Aerators. They were removed and are being repaired. They will be installed and started next week if the ice is thick enough to set up the barrier fence. Perch Lake Project Motion by Hense, seconded by Menter to go into closed session pursuant to Wis. Statute Sec. 19.85(1)(e) to deliberate on the acquisition of property. Motion carried. Motion by Hense, seconded by Menter to reconvene into open session pursuant to Wis. Statue Sec. 19.85(2). Motion carried. During closed session staff was instructed to proceed with the preliminary property survey by meeting with the Seims and the neighboring property owners. Grant asked if the Committee was interested in having a student from UW-River Falls do an independent study project on the Perch Lake property. The University prefers that the students receive a $500 stipend for expenses. Committee indicated that there is no money available for a stipend but if a student would like to do an independent study at no cost to the County it would acceptable. Woodville Trail Grant has received several calls from citizens who feel that horses riders may be prevented from using the Woodville Trail. The concern is based on an article in the Woodville paper. The article talks about upgrading the trail for bike riding. Steve Holzer, President of the Willow River Riders Saddle Club, said his organization has created maps for members showing trails through the County on private land, along roadways and on the Woodville Trail. He said he has been told that work has been done to upgrade the trail for bike use and that surfacing the trail for bikes may eliminate horse usage. He does not want to see horses or bikers taken off the trail but he feels it is usable as a bike trail in its present condition. Sandy Scott, a Woodville resident, stated that she would like the trail to have a better surface for horses to ride on than there is now. She is gathering signatures on a survey regarding the use of the trail. She feels no one knew that the trail was being changed for use by bikers and that there is no need for changes because it is fine as it is. She assumed that a bike path would be a blacktopped area beside the trail that exists. Grant indicated that the County has a plan and some money available to make improvements to the trail next year by replacing culverts, improving road grades and brushing. The trail right-of-way ranges from 90 to 200 feet but the railbed surface is probably between 10 and 15 feet. Grant stated that the ad -hoc group has been working on turning the trail into another Red Cedar Trail. There are some segments of the trail that could be used as a double track for both horses and bicycles and walkers. Hense indicated that there may be conflicts between usage by bikers and horses due to horse droppings but it has not been a problem because there has been limited usage by bikers due to the condition of the trail. Luckey added that the Village of Woodville sees this as a tourism and an economic development opportunity. Raymond thanked the citizens for their input. However, he feels that there is no problem on the trail because the parks ordinance does not presently limit access to the trail except for motorized vehicles, excluding snowmobiles. If usage becomes a problem then the committee will discuss options and ways to deal with it. Committee members recommended that interested citizens work with the Parks Director and the ad -hoc group which is working on improving the trail. Grant obtained addresses and phone numbers. He will contact people regarding meetings. The work on the Woodville Trail box culvert is done for the year. Pictures were passed around showing the project. Mulching was completed but seeding was not. It will be done next spring along with some fencing. Motion carried. County Development Management Plan/Zoning Ordinance No discussion. No action. Resolution on Metropolitan Development Issues Denzer reported that the Metropolitan Development Issues resolution was reviewed and revised by the Administration Committee. Committee members reviewed the changes. Motion by Hense, seconded by Menter to approve the Resolution as revised by the Administration Committee. Motion carried. Purchase of FAX Machine Committee had reviewed the materials provided by Planning Director Dave Fodroczi and Nelson regarding the purchase of a FAX machine for the Planning and Development suite. The machine would be similar to the one in the County Clerk's Office and would cost $2,095. A chart was provided outlining line item transfers from the Planning, Real Property, Recycling, Land Records and Zoning budgets to cover the cost of the FAX machine from the 1996 budget. The line item transfers will be presented to the Finance Committee on December 9th. Motion to approve by Hense, seconded by Menter. Motion carried. The Committee requested that the December meeting agenda include the following item: "Closing the Zoning Department to the public during certain hours."
