HomeMy WebLinkAboutPlanning Zoning & Parks 04-03-97PLANNING, ZONING AND PARKS COMMITTEE MEETING April 3, 1997 PRESENT: Chairman Tom Dorsey, Vice Chairman Ron Raymond and Committee Members George Menter, Dave Hense and Linda Luckey. Staff. Ellen Denzer, Joe Grant and Dave Fodroczi. Others: Pat Collins; Lucy McNellis; Ted and Renate Mackmiller; John Sybrant; Mike and Jeanne Ottman; Jan Gavin; Jim and Daria Aysta; and Jack and Shirley Dowd. Chair Tom Dorsey called the meeting to order at 4:37 p.m. Motion by Menter, seconded by Hense to approve the agenda. Motion carried. Concerns of Residents and Property Owners on 53rd St. Planning Director Dave Fodroczi reviewed the attached memo describing the concerns of the 53rd Street property owners and the staff recommendations concerning those issues. He also reviewed a letter from Attorney William Radosevich who was representing Jim and Daria Aysta. He concluded by saying that the issue which seems to be the most divergent is public use of 53rd Street. Mr. Aysta presented a list of issues from the residents and property owners. Please see attached. He stated that they would prefer not to get involved in a discussion of ownership. If the other issues can be resolved then ownership can be resolved. Aysta also handed out a map and photographs of the road in front of the property owners' homes. They feel public use of the road is inappropriate -- it is narrow, partially under water and there are small children present. The property owners reviewed the history of the roadway and their concerns regarding misuse by the public. Discussion. Motion by Raymond, seconded by Menter to rescind the offer of limited access to the one scuba diving club. Motion carried 4 to 1, Dorsey voted no. Since the Committee closed the property to the general public at the February 14, 1997 Committee meeting, this action eliminates all public access at this time. Fodroczi suggested agreeing to get together and negotiate an agreement regarding the remaining issues with two or three representatives for each side. Fodroczi, Grant and Planner Ellen Denzer will represent the County, Aysta, Pat Collins and Ted Mackmiller will represent the property owners. The group will try to have the issues resolved by the April 22 PZAP Committee meeting. Motion by Hense, seconded by Raymond to adjourn.
