Ron Raymond, Linda Luckey, Dave Hense. Staff present: Mary Jenkins Chairman Dorsey called the hearing to order at 8:05 PM. The agenda was read into the record. Zoning Business: (1). Donald C. Riggott to rezone a 40 acre parcel of land from Agriculture to Agriculture/Residential. Location: The NE 1/4 of the SE 1/4 of Section 19, T29N-R16W, Town of Baldwin, St. Croix County, Wisconsin. Donald Riggott, 3540 Neil Avenue, Afton, Minnesota 55001, told the committee that he is requesting the rezoning in order to create 3 or 4 residential lots on the 40 acres. He does not plan to further subdivide the property. He said that he has gotten approval from the town board. Joe Hurtgen, Chairman, Town of Baldwin, spoke, saying that he had understood at the time the town gave approval, that Mr. Riggott was only going to build 1 house. He said that the township has exclusive Ag zoning, and he thought the intent of that zoning was to preserve farm land. Mr. Riggott answered that he had always intended to subdivide, and that he would not have needed to rezone to build 1 house. The township was unanimous in recommending approval of the rezoning. Paul Loldcer, 857 220th Street, Baldwin, Wisconsin, rents the land from Riggott, and has rented it for 15 years, told the committee that it is not real good farm land. Loldcer said that there is at least 1 acre that he could not plant because it is too wet. Mr. Loldcer supports the rezoning, as the township will realize better tax benefits on the property than if it was left bare farm land. The committee asked about soil types on the property, and Jenkins told them that there are Class II and Class III soils, predominately Class III. Eugene Zimmerman, Town Board Supervisor, supports the rezoning, acknowledging the tax benefits for the township. Jenkins read a letter from Bruce & Penelope Siegersma, adjoining land owners, opposing the rezoning. Reuben Doornink, who lives directly across from the property, opposes the rezoning, as he wishes to preserve farm land. Chairman Dorsey called for further questions or comments, and when none were received, asked for a motion to close the hearing. A motion was made by Hense, seconded by Menter, to close the hearing. Motion carried. A motion was made by Hense to recommend approval of the rezoning to the County Board, stipulating that it meets the requirements of Wisconsin Statutes Sec. 91.77. Dorsey seconded the motion. Motion carried. Hearing adjourned at 8:25 PM. (2). Zoning Ordinance Amendments for telecommunications facilities. Dave Fodroczi, Planning Director, told committee members that staff has been working with committee and local officials, and presented a draft of amendments to the Zoning Ordinance. The amendments would add one whole new subchapter to the existing zoning ordinance, giving provisions to deal with wireless communication facilities within the county. The draft is based on input from county people, the review of several ordinances from the Twin Cities area, input from counties and cities that have an ordinance in place, information from the Internet, and information received from private consultants. Fodroczi gave the committee a brief overview of the contents of the draft, including definitions, siting of facilities, pre-existing towers and antennas, height restrictions, and the possible side effects and potential impacts of siting and regulating communication facilities. The draft gives preference to facilities located within industrial or commercial zoning districts, and adding to an existing tower, addressing those as a permitted use, with new towers being a special exception use. There was discussion on township participation, zoning district requirements, and permitted and special exception uses. A committee decision was made to read the draft and discuss it at the scheduled August 12 meeting. A public hearing has been scheduled for August 14, with County Board receiving the amendments at their August 19 meeting. (3) Perch Lake Owners/ Pat Collins, Grading and filling on the bed of a navigable body of water. Pat Collins, Perch Lake resident, appeared before the committee regarding a Board of Adjustment permit for filling and grading on Perch Lake. Collins originally requested an extension of a permit previously granted by the Board of Adjustment, however, the committee felt that a new special exception permit is required as there is additional work needed, not additional time. The county now has an ownership issue in the road, and it is felt that the county should be a party to the application, or assign the right to allow others to file a new application. A motion was made by Luckey, seconded by Menter, to recommend to the Finance Committee that the county assign the right and allow other property owners to file the application for filling and grading on the bed of Perch Lake to repair 53rd Street. Motion carried. Collins will submit the application to the Zoning Office, and the matter will be placed on the Finance Committee Meeting agenda on August 11. Discussion on how to deal with any emergency matters that may come up prior to August 11. Collins was told that in that event, the committee would support only absolutely necessary measures. Collins should contact David Dacquisto at the Zoning Office should emergency measures need to be taken. A motion was made by Menter, seconded by Hense, to adjourn. Motion carried.
