Staff feuds that the proposed project meets the spirit and intent of the St Croix County 715 -4677 Zoning Ordinance and Shoreland District with the following findings: g g 1. Single- family dwellings are allowed with a land use permit in the Shoreland District - 386 -4675 pursuant to Section 17.35(2)(b) of the St. Croix County Zoning Ordinance; 2. The proposed principal structure will be located over 75 feet fi the OHWM of Bass Lake and will meet all required road and side yard setbacks; ' 4. The slopes within the OHWM setback area are over 25 percent and currently feature dense tree and shrub cover, which the applicant plans to leave intact. The Wisconsin Department of Natural Resources has not objected to these requests. Based on these findings, approval of the land use permit is subject to the following conditions: 1. The height of the single - family dwelling and attached garage shall not exceed 35 feet as measured from the lowest adjacent grade to the midpoint between the eaves and the peak. 3. Prior to commencing construction, the applicant shall install sediment logs around the perimeter of the construction site and stockpile areas draining toward the lake. The sediment logs shall be installed on the flat area along the top of the steep slopes. During construction, the smallest amount of bare ground shall be exposed for as short a time as possible. Immediately upon completing construction, temporary ground cover shall be used and the sediment logs shall remain and be maintained until permanent, self - sustaining vegetation is successfully established. 4. No phosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed. 5. The applicant shall be responsible for installing three rain gardens to capture and infiltrate storm water runoff from the impervious coverage on the site in accordance with the storm water management plan submitted on .tune 8, 2007. Within 30 days of completing construction, the applicant shall execute and record an affidavit against the property referencing the storm water management plan and maintenance requirements for the rain gardens and all drainage ways with the Register of Deeds, and provide the Zoning Administrator with recorded copies of these documents. 6. The current level of native trees, shrubs, and groundcover along the shoreline, within the 75 -toot OHWM setback area, and on all slopes 25 percent and greater shall be maintained in order to: • substantially screen the dwelling from the lake during summer leaf -on conditions, • filter and slow storm water runoff before reaching the lake, • stabilize the steep slopes to prevent erosion and sedimentation, and • preserve the natural ecology and wildlife habitat in these sensitive areas (see Condition #7). 7. Within 60 days of completing construction, the applicant shall submit to the Zoning Administrator photos of the completed project as viewed from all angles, including the shoreline of Bass Lake. The photographs must also show all storm water management measures including roof gutters, rain gardens, and /or any designated infiltration areas. The applicant shall plant additional native trees and shrubs as required by the Zoning Administrator to meet the conditions above. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. You must obtain a building permit from the Town of St. Joseph prior to commencing construction. The primary source for construction site runoff will be the house foundation excavation, driveway, well drilling, and soil stockpiled until final grading and stabilization is complete. Septic system installation adds to temporary disturbance, but establishing cover on exposed soils will prevent erosion. Apply seed and mulch as recommended in #5 below. Surface drainage is westerly toward steep slopes along the shore of Bass Lake and <100 feet from the edge of water according to Certified Survey Map. 2. Install construction entrance before any excavation begins!! Construction equipment and vehicles must utilize a stabilized driveway access off public road for heavy equipment; this includes cement trucks, well drillers, and other contractor's vehicles that require access to the property during construction. Avoid muddy, rutted conditions that may allow contaminated runoff to reach waterways and /or drainage ditches. Property owner must repair damage to ditches resulting from multiple access points and sediment tracked on public roadways must be removed at the end of each workday. 3. Do not allow contaminated runoff to be directed onto neighboring property or into surface water conveyances. 4. Installation of approved sediment control products (straw wattles, silt fence, and /or erosion control matting) is a requirement of the Special Exception Permit. Install wattles per manufacturer specifications as a perimeter sediment control barrier along the 75' setback line. Leave a buffer of undisturbed soil between the wattles and grading/excavation areas. The POWTS inspector and /or building inspector will evaluate ESC plan effectiveness and make recommendations to owner for any action required to comply with applicable regulations. Please contact the county zoning or LWCD staff if you have questions during installation of the p erimeter barrier. $T. When late - season weather conditions will not permit seed germination, a heavy straw mulch cover will prevent erosion until vegetation can be established. Proper maintenance consists of pumping out the septic tank every three years or sooner, if needed, by a licensed pumper. What you put into the system can affect the function of the septic tank as a treatment stage in the waste disposal system. Owner maintenance responsibilities are specified in §Comm. 83.52(1) and in Chapter 12 - St. Croix County Sanitary Ordinance. Code each Private Onsite Wastewater Treatment System (POWTS) shall include information and procedures for maintaining the system within the parameters of Comm 83 and 84, and the conditions of approval by the department, agent, or governmental unit. The contents of the septic tank shall be disposed of in accordance with NR 113, Wis. Adm. Code (Servicing Septic or Holding Tanks, Pumping Chambers, Grease Interceptors, Seepage Beds, Seepage Pits, Seepage Trenches, Privies, or Portable Restrooms). The operating condition of the septic tank and outlet filter shall be assessed at least once every 3 years by inspection. The outlet filter shall be cleaned as necessary to ensure proper operation. The filter cartridge should not be removed unless provisions are made to retain solids in the tank that may slough off the filter when removed from its enclosure. If the r Management Plan for a Septic Tank and Soil Absorption Component filter is equipped with an alarm, the filter shall be serviced if the alarm is activated continuously. Intermittent filter alarms may indicate surge flows or an impending continuous alarm. The septic tank shall have its contents removed when the volume of scum and sludge in the tank exceeds 1/3 the liquid volume of the tank. If the contents of the tank are not removed at the time of an assessment, maintenance personnel shall advise the owner of when the next service needs to be. performed to maintain less than maximum scum and sludge accumulation in the tank. Manhole risers, access risers and covers should be inspected for water tightness and soundness. Access openings used for service and assessment shall be sealed watertight upon the completion of service. Any opening deemed unsound, defective, or subject to failure must be replaced. Exposed access openings greater than 8- inches in diameter shall be secured by an effective locking device to prevent accidental or unauthorized entry into the tank. No one should enter a septic or other treatment or holding tank for any reason without being in full compliance with OSHA standards for entering a confined space. The atmosphere within the septic or other treatment of holding tank may contain lethal gases, and rescue of a person from the interior of the tank may be difficult or impossible. Tank abandonment shall be in accordance with Comm 83.33, Wis. Adm. Code when the tank is no longer used as a POWTS component. Soil Absorption Component The soil absorption component serving this structure is designed to accept domestic wastewater from a residential facility. The limits of operation of this component are shown in Table 2. The longevity of a soil absorption component depends greatly on proper and timely maintenance, and system use within or below the limits of reliable operation. Good water conservation practices by all occupants and the installation of water conserving plumbing fixtures are key factors in extending the useful life of this component. The soil absorption component's operation must be assessed by inspection at least once every three years. The inspection shall include recording the levels of ponding, if any, in the observation pipes, and a visual inspection for any evidence of surface seepage or discharge from the component. On steeply sloping sites, areas of erosion should be identified and reported to the owner for repair. The surface discharge of domestic wastewater or sewage from the system is prohibited and considered a human health hazard. Traffic around or over the soil absorption component should be avoided particularly during winter months. The compaction or removal of snow cover over the component may lead to hydraulic failure by freezing. This type of failure is usually temporary, but is difficult or impossible to repair until weather conditions improve. In general, soil compaction over this component will reduce diffusion of oxygen into the soil and dispersal cell, which may lead to more intense, and earlier, organic clogging of the soil. 2 r Management Plan for a Septic Tank and Soil Absorption Component Plantings of deep- rooted trees and shrubs directly over or within ten feet of the component should be avoided since root intrusion into the component may obstruct wastewater flow. The site plan and grading limits that you submitted do not indicate where storm water drainage and infiltration areas will be located on the site, or how much additional area will need to be disturbed to install them. You must revise your site plan to include these features. If the total disturbed area exceeds 10,000 square feet, you will need to apply for a special exception permit. An erosion and sediment control plan for the entire project area including a description of construction sequencing, contact information for all contractors and subcontractors, pre and post construction 2 -foot contours, pre and post construction drainage patterns, the locations and quantities of BMPS (silt fencing, straw waddles, etc.), and existing and proposed vegetation pursuant to Section 17.29 (2)(c)4. We discussed each of the items above when you stopped by the Planning and Zoning Department prior to submitting your permit application, but I did not see them in your application materials. As soon as I receive these items from you, I will resume processing your permit. In the mean time, Steve Olson (Rural Land Specialist), Pam Quinn (Sanitary Specialist), and I plan to conduct a site visit on the property on Friday, June 8, at approximately 10:30 AM.
