Pat said he had been in contact with Mr. John Dahl, commercial building inspector. Pat indicated that Mr. Dahl was not going to get involved on conditionally approving the mobile home for temporary commercial use. Pat said Mr. Dahl pointed out that Commerce Code chapter 50.03(6) indicated that the town or county had the ability to approve conditional usage of a commercial structure for 180 days. Mr. Dahl also told him that the town should verify that an engineered plan that was signed and stamped, should be submitted to the town showing a tie - down system plan for the mobile home in the event of stormy or windy weather. Mr. Dahl was also said to ensure that the steps and railings installed would meet the current code standards. Pat said he felt that the White Eagle golf course was in a sort of "catch 22" position. He said that the zoning department wasn't issuing the septic system permit until commercial approval of the mobile home was obtained, and that the commercial status could not be granted until septic approval was received. Mr Collins indicated that he was inclined to approve the mobile home for conditional commercial use, pending septic permit approval, for one season only. He said that the next town meeting was on April 5, 2001. Pat also asked if I would pass this information on to you, and have you give him a call tomorrow when you get a chance. Thanks. Otherwise it's okay to go off lot with a system or parts of a system as long as appropriate easements for use and maintenance are in place. For example, you probably don't want to allow an easement only large enough for the system when more area is required to drive equipment around to work on or maintain the system. There should probably be a construction zone around or next to the system, and of course it wouldn't be smart to but a system right up to an easement line since an inch over could cause trouble with a neighbor. I'm not sure if we treat an easement line just like a property line (5 -foot setback), but I don't think so even though the easement effectively erases the P/L for setback purposes. The new code does not require a replacement area per se. However, it does require a contingency plan in the event of failure, and the plan must be acceptable to the plan review authority (e.g. state or county). This is where it would be nice if you had a new county sanitary ordinance in effect. You could use your ordinance to state what kind of contingency plans you expect for new or replacement situations. The two most common would be replacement in an area nearby or replacement below the existing system (if soil conditions permit). There could be other acceptable methods too. Pat said he had been in contact with Mr. John Dahl, commercial building inspector. Pat indicated that Mr. Dahl was not going to get involved on conditionally approving the mobile home for temporary commercial use. Pat said Mr. Dahl pointed out that Commerce Code chapter 50.03(6) indicated that the town or county had the ability to approve conditional usage of a commercial structure for 180 days. Mr. Dahl also told him that the town should verify that an engineered plan that was signed and stamped, should be submitted to the town showing a tie -down system plan for the mobile home in the event of stormy or windy weather. Mr. Dahl was also said to ensure that the steps and railings installed would meet the current code standards. Pat said he felt that the White Eagle golf course was in a sort of "catch 22" position. He said that the zoning department wasn't issuing the septic system permit until commercial approval of the mobile home was obtained, and that the commercial status could not be granted until septic approval was received. Mr Collins indicated that he was inclined to approve the mobile home for conditional commercial use, pending septic permit approval, for one season only. Common Use Systems: review Unless a common use systems, sanitary s systems, the department will a g conductallsuch This is similar to how we operated under the old code. Under the new code, Table 83.22 - 3 indicates that the county may review a POWTS that wil serve a single one- or two - family dwelling. This means a single structure with one or two living units in it, not two single structures connected to a common system. Therefore, there is a need for department review. As an agent, the county could review common use systems under its jurisdiction. For example, if an agent had review authority for mound systems, it could also get review the would for in- ground authority for common use mound systems, j ust as Y systems under similar circumstances. Private interceptor main sewer approval by the Department is still required until September 1, 2000. However, after September 1st, Department approval is no longer required for 4 inch diameter private interceptor main sewers. You should familiarize yourself with the rules for private interceptor main sizing and cleanout requirements prior to reviewing any such plans. Off Lot Systems: The new code no longer addresses who may do plan reviews for off lot systems so such reviews may be done locally. One word of caution however, you will want to make sure all appropriate easements are in place before issuing a permit to install.
