Community Development staff have reviewed the application for construction of an accessory
structure (attached deck) onto the principal structure. An accessory structure is permitted in the
Lower St. Croix Riverway Overlay District, pursuant to Chapter 17.36 F.2.a.9). The request has been
conditionally approved based on the application submission and the following findings.
• The proposed deck is 17' x 12' (219 square feet) and will comply with all structure setbacks as per
Chapter 17.36 G.S., with condition the reduced bluffline 40-foot setback shall be flagged prior to
construction.
• The structure will not be located in a slope preservation zone, nor will any filling and grading within
this area be necessary.
• Filling and grading is limited to digging out three (3) 12" diameter deck footings, 4' below grade.
• The area below the proposed deck location is a patio. Vegetation removal is not necessary nor will
be removed as a part of construction.
• Stormwater management plan is not necessary for this project as the deck material is not considered
an impervious surface.
• There is an existing deck attached to the home and majority of which is located within the reduced
40-foot bluffline setback. Ordinary Maintenance and Repair as defined per Chapter 17.09 176. is
allowed, however reconstruction or replacement of the structure's foundation requires a Variance
as per Chapter 17.36. 17.09176. Ordinary Maintenance and Repair: Any work done on a
nonconforming structure that does not constitute expansion, structural alteration or reconstruction
and does not involve the replacement, alteration or improvement of any portion of the structure's
foundation.
Based on these findings, approval of the Land Use Permit is subject to the following conditions:
1. The 40-foot setback to the bluffline shall be flagged at time of construction to avoid accidental
encroachment and silt logs shall be installed downslope of the deck footings. The bluffline is a line
along the top of the slope preservation zone, which is a rivenaard slope 12% or more, measured

horizontally for a distance of nor more than 50 feet or less than 25 feet, and is established in the site
plan drafted by Edwin Flanum on 6/8/2020.
2. The deck material shall be an earth tone in color and the existing vegetative screening shall remain
so that the addition is not readily noticeable from the River.
3. There shall be no grading within 40-feet of the bluffline or within the slope preservation zone without
Conditional Use Permit approval as per Chapter 17.36 G. Changes to the overall
grading/construction plan are proposed shall be submitted for review first.
4. St. Croix County reserves the right to require additional sediment and erosion control measures or
vegetation to be installed if found necessary due to site -specific concerns.
5. A post -construction inspection is required to close out the permit. It is the applicant's responsibility
to schedule this appointment, please contact me at (715) 386-4742 to schedule.
6. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and
approval(s) prior to land disturbance activity. Including permission from the Town of Troy regarding
a building permit and compliance with Town general zoning setbacks.
7. Failure to comply with the terms or conditions above may result in the revocation of this permit by
the Zoning Administrator according to Chapter 17.36.
This approval is subject to the conditions listed above; it does not allow for any additional
construction, structures, or buildings beyond the limits of this request. Your information will remain
on file at the St. Croix County Community Development Department suite. It is your responsibility
to ensure compliance with any other local, state, or federal permitting or regulations, including
contacting the Town of Troy to inquire if additional permissions are required.
This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the
applicant submits the appropriate permit extension fee and documentation to the Zoning
Administrator. A copy of the Land Use Permit placard should be submitted to the local Building
Inspector for the town upon application for the building permit. The orange placard must be posted
on thejobsite and visible from public view.

GENERAL APPLICATION REQUIREMENTS
APPLICATION:
Applications will not be accepted until the applicant has:
• Met with the Zoning Administrator to review the application;
• Submitted Original plus 2 copies of the entire packet including all supporting information, maps
diagrams;
• Resolved any land use violations and paid any outstanding fees owed to the Community Development
Department;
Signed the application form (the signatures of the property owners and agents acting on their behalf ore
required), and
Submitted the appropriate application fee (nonrefundable) payable to: St, Croix County.
REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the
application. The Zoning Administrator may require additional information and will notify the applicant of this
within 10 days. Upon receiving a complete application and supporting documents, the Zoning Administrator
will:
• send copies of the applications to the appropriate reviewing agencies for comment. Applicants are
encouraged to contact their town to discuss their application and inquire about necessary
building permits and approvals at the town level,
• schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable
property/project corners and label the flags accordingly; and
• review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval,
the permit will be mailed to the applicant or to the applicant's agent.
If approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant
may also be required to apply through the Town for a local building permit. All site plans, pictures, and other

aterials submitted with the application become the property of the Community Development Department
and will remain in the file.
