RE: Conditional Approval: Land Use Permit, File# LUP-2020-019
Project Location: Sec.13 T28N R20N .659B, Town of Troy
Dear Patrick and Catherine Delaney,
Community Development staff have reviewed the application for construction of a storm safe room
attached to the detached garage at 304 Cove Road. An accessory structure is permitted in the Lower
St. Croix Riverway Overlay District, pursuant to Chapter 17.36 F.2.a.9). The request has been
conditionally approved based on the application submission and the following findings.
• The proposed addition is 7' x 10', including the roof overhang, and will be added on to the detached
accessory structure near the garage door. The original structure was approved in 2003 as per file
number 03LU11.
• The addition will comply with all structure setbacks as per Chapter 17.36 G.S., with condition the
reduced bluffline 40-foot setback shall be flagged prior to construction. Per Chapter 17.36 G.5.a.1)
on modification to existing structures, roof overhangs shall not encroach within the required setbacks
more than three -feet.
• The structure will not be located in a slope preservation zone.
• As per Chapter 17.36 H.7, stormwater management and erosion control plans are not required for
accessory structures less than 100 square feet. Overall land disturbance will be minimal and the roof
layout will not send stormwater directly to the bluffline.
• Vegetation removal is not a scope of this project, only minimal pruning of nearby by trees is needed.
Based on these findings, approval of the Land Use Permit is subject to the following conditions:
1. The 40-foot setback to the bluffline shall be flagged. The bluffline is a line along the top of the slope
preservation zone, which is a riverward slope 12% or more, measured horizontally for a distance of
nor more than 50 feet or less than 25 feet. It is highly recommended to contact a registered land
surveyor to flag this for you.
2. A pre -construction inspection is required to discuss the construction timeline, identify which trees
are to be pruned, and to verify that 40-foot bluffline setback has been staked prior to construction.

3. The addition shall be an earth tone in color and the existing vegetative screening shall remain so
that the addition is not readily noticeable from the River.

4. There shall be no grading within 40-feet of the bluffline or within the slope preservation zone without
Conditional Use Permit approval as per Chapter 17.36 G. Changes to the overall
grading/construction plan are proposed shall be submitted for review first.
5. St. Croix County reserves the right to require additional sediment and erosion control measures or
vegetation to be installed if found necessary due to site -specific concerns.
6. A post -construction inspection is required to close out the permit. It is the applicant's responsibility
to schedule this appointment, please contact me at (715) 386-4683 to schedule.
7. It is the applicants responsibility to secure any other required local, state or federal permit(s) and
approval(s) prior to land disturbance activity. Including permission from the Town of Troy regarding
a building permit and compliance with Town setbacks.
8. Failure to comply with the terms or conditions above may result in the revocation of this permit by
the Zoning Administrator according to Chapter 17.36.
This approval is subject to the conditions listed above; it does not allow for any additional
construction, structures, or buildings beyond the limits of this request. Your information will remain
on file at the St. Croix County Community Development Department suite. It is your responsibility
to ensure compliance with any other local, state, or federal permitting or regulations, including
contacting the Town of Troy to inquire if additional permissions are required.
This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the
applicant submits the appropriate permit extension fee and documentation to the Zoning
Administrator. A copy of the Land Use Permit placard should be submitted to the local Building
Inspector for the town upon application for the building permit. The orange placard must be posted
on the job -site and visible from public view.
