Attn: Tom Zwald 426 165th Street Hammond, WI54015 Re: Land Use Permit for an animal waste storage facility located in Sec. 8, T28N, R17W, NE '/4 of the SW '/4 of the Town of Pleasant Valley Dear Tom Zwald, This letter confirms zoning approval for a Construction Permit according to the plans you have submitted for an animal waste storage facility at the location referenced above. Staff finds that the proposed project meets the requirements of the St. Croix County Animal Waste Storage Facility Ordinance and the St. Croix County Zoning Ordinance with the following findings: 1. An animal waste storage facility is subject to the Animal Waste Storage Facility Ordinance and Zoning requirements. 2. An animal waste storage facility is allowed with a land use permit pursuant to Section 11.3 A. of the St. Croix County Animal Waste Storage Facility Ordinance. 3. The proposed storage facility meets the required setbacks pursuant to section 17.12 (13) of the St. Croix County Zoning Ordinance. 4. The applicant submitted a manure storage facility plan that includes; engineered plans, operation and maintenance plan, soil logs, construction inspection plans, construction specifications, grading plans and erosion control plans. 5. The proposed manure storage facility is not located in a Floodplain, Shoreland or Shoreland- wetland area. 6. The proposed animal waste storage structure complies with the standards in Section 11.2 A. of the St. Croix County Animal Waste Storage Facility Ordinance. Based on these findings, approval of the land use permit is subject to the following conditions: 1. The applicant shall provide an as -built drawing of the constructed animal waste storage facility signed by a professional engineer. 2. The applicant shall obtain an operation permit from St. Croix County prior to use of the structure. 3. The applicant shall submit annually a certified 590 nutrient management plan for the operation. The applicant shall remain in full compliance with Wisconsin Administrative Code ATCP 50 and NR 151. 5. Any modifications require approval from the Code Administrator. 6. Upon transfer of ownership a written notice shall be submitted to the Code Administrator. 7. This permit is valid for one year. A request can be made for one additional year. 8. If this operation ceases operations for a period of 24 months this pit shall be closed according to 11.3 E of the Animal Waste Storage Facility Ordinance. 9. The owner shall give five working days notice to the Community Development Department prior to starting construction. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in the St. Croix County Community Development Department. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including obtaining a building permit from the Town of Pleasant Valley if one is required. REVIEW: The Zoning Administrator will review the application for completeness and assign i file number to the application. The Zoning Administrator may require additional information and will i otify the applicant of this within 10 days. Upon receiving a complete application and supporting documents, he Zoning Administrator will: • send copies of the applications to the appropriate reviewing agencies for c ment Applicants are encouraged to contact their town to discuss their application and inqu re about necessary building permits and approvals at the town level; • schedule a site visit to the applicant's property, at which time the applicant hall flag all applicable property/project corners and label the flags accordingly; and • review the file and prepare findings for approval or denial of the permit witl in 60 days. Upon approval, the permit will be mailed to the applicant or to the applicant's agent. If approved, the land use permit will be valid for one year from the date of the perr dt issuance. The applicant may also be required to apply through the Town for a local building permit. All site lans, pictures, and other materials submitted with the application become the property of the Community 0 Rvelopment Department and will remain in the file. Page 2 of 3
