C ROIX CWI,'N'Ylll,sf'lZ 6/30/2020 Ben Simon 1478 85th Street New Richmond, WI 54017 Community Development Government Center 1101 Carmichael Road I Hudson WI 54016 Telephone: 715-386-4680 1 Fax: 715-386-4686 www.sccwi.gov RE: Land Use Permit for nonmetallic mining site — borrow pit Located in the SW t/a of the SW 1/a of section 18, T30N, R18W, Town of Richmond Parcel # 026-1052-70-000 Dear Mr. Simon, Community Development staff have reviewed the application for a nonmetallic mining permit for a borrow site used in connection with a municipal contract for the construction, reconstruction, maintenance and repair of a public highway, when the borrow site is not adjacent to the transportation project property, as per Chapter 14 Nonmetallic Mining, specifically 14.3 A.1.c(2). The request has been conditionally approved based on the application submission and the following findings. Please see the enclosed site plan to reference the general erosion control and grading notes. Findings: 1. The operator will be Total Excavation, LLC. 2. The borrow pit will be used to export granular fill for the Town of St. Joseph road reconstruction and repair projects. 3. The topsoil will be stripped, stockpiled, and then used to cover the area of excavation when complete. The topsoil will be stabilized with a tactifier and temporary seed mix. 4. A 100-foot buffer will be maintained to all property lines. 5. The hours of operation will be from 7:00 AM to 6:00 PM — Monday through Friday. 6. There will be no mining into the groundwater. 7. The project meets all the other applicable provisions in Sections 14.2 A. 1 through 9, B. 1 through 4 and C.1. of the St. Croix County Non -Metallic Mining Ordinance. 8. Financial Assurance is not required for this project. 9. Silt fence will be installed below all work areas. 10. A water truck will be used to spray water on haul road areas as needed to control dust. 11. The post mining land use will be agricultural crop farming. Silt fence shall be installed as shown on the site plan and shall remain in place throughout the duration of the project. 2. There shall be a tracking pad constructed of 3-inch to 6-inch diameter stone within the road right-of-way to aid in the removal of soil material on vehicle tires prior to exiting the site and accessing 1501' Avenue. 3. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. 4. The applicant shall notify the Zoning Administrator of any change in name or ownership of the approved facilities and provide new contact information for the purpose of keeping the file updated. 5. Any minor change in the project (or addition) in the project shall require prior review and approval by the Zoning Administrator. Any major change and/or addition to the originally approved plans will require the submittal of a new Land Use Permit or Conditional Use Permit application. 6. The post mining land use shall return to agricultural crop production, as stated in the application. 7. The site must be mined and reclaimed within 36 months of the date of this permit, or immediately upon completion of the road projects listed in the municipal contract, whichever is less. The applicant shall file a notice of completion with the Community Development Department. 8. A post -mining inspection is required to close out the permit. It is the applicant's responsibility to schedule this appointment, please contact me at (715) 386-4680 to schedule. 9. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator. This approval is subject to the conditions listed above, it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Richmond to inquire if additional permissions are required. The orange Land Use Permit placard must be posted on the borrow pit site and visible from public view.
