Dear Warren and Deborah Buerkley,
Community Development staff have re eared the application to construct a new single-family
residence to replace the existing residence on the property in the Lower St. Cmv Riverway, Overlay
District The request has been conditionally approved based on the application submission and the
following findings Please see the enclosed site plan to reference the general erosion control and
grading notes
• On August 27, 2020, a Conditional Use Permit was approved for filling and grading 1g000 square
feet or more outside of the slope preservation zone A condition of this permit requires a native
plant buffer to extend parallel to the bluf8me and a stormwater afGdawt to be recorded within 30
days after construction is completed
• A Land Use Permit Is required to construct the residence and subject to the performance standards
po Chapter t] 36 F 2a 1) A revised site plan was submitted as a factor the CUP on 8/5/2020 and
is included as a pan of the land use permit application
• Erosion and Sediment Control and Stormwater Management plans have been submitted that meet
Wisconsin Department of Natural Resources Technical Standards Best Management Practices Vail

• Limited vegetation removal within the bluf0lne setback is proposed and approved as a part of this
Permit Vegetation located within the slope preservation zone or OHWM setback will not fire

• The new residence will require a County Reconnection Permit to connect to the existing Private
Off Wastewater Treatment System (BOATS) The existing system was replaced In 2019
Based on these findings, approval of the Land Use Permit is subject to the following conditions.
1 The slope preservation zone shall be flagged prior to site construction A double rowof silt fence is
required along the bluf8me and the sit fence will need to extend to the south property line

2 It is recommended that the proposed stormwater features are flagged off to prevent additional
companion from construction activities When the infiltration areas are being installed, please
contact staff so that the areas can be evaluated
3 A County Reconnection Permit to connect to the existing POWTS will be required.
4 A pre- onstructwn mspecLan is required to discuss the construction timelme (see condition x2
above) and to verify that erosion and sediment control are installed per plan Please callin atp15)

5 Once construction has been completed and all filling and grading is finalized, a native plant buffer
shall be planted parallel to the bluf8ine as required in the Conditional Use Permit application (CUP-
2020-008) Please contact our Department if you have any questions on native vegetation.
6 An affidavit shall be required describing the approved stromwater management, erosion and
sediment control, native plant buffer and maintenance requirements within 30 days after
construction is completed pursuant to Chapter l] 36 IT ]g
7 There shall be no filling and grading within 40-feet of the Mull other than the minimal amount
necessary as shown on the plans submitted 8/5/IDd0 to remove the existing structure, install one
raingarden and to reach final grade.
8 All new structures shall be earth tone in color
9 All temporary erosion control measures shall be left in place and maintained until the site has reached
a point of at least 70% permanent vegetation Permanent vegetation shall bs established once final
grade is reached or as soon as applicable per plan
10 A post -construction inspection is required to close out the permit. Please contact me at(715)386-

11 It is the applicant's responsibility to secure any other required local, state or federal parents) and
approvals) prior to land disturbance activity
12 Failure to comply with the terms or conditions above may result in the revocation of this permit by
the Zoning Administrator according to Chapter 17 36
This approval is subject to the conditions listed above, it does not allow for any additional
construction, structures, or buildings beyond the limits of this request Your nformation will remain
on file at the St Croix County Community Development Department suite It is your responsibility
to ensure compliance with any other local, state, or federal permitting or regulations, including
contaning the Town of St Joseph to inquire if additional permissions are required
This permit Is valid for one year, with the possibility of up to two (2) six-month extensions ifthe
applicant submits the appropriate permit extension fee and documentation to the Zoning
Administrator A copy of the Land Use Permit placard should be submitted to the local Building
