The request has been conditionally approved based on the application submission and the following findings The conditionally permafrost structures are proposed in the Town of Somerset, within a Shoell Overlay Distract • Proposed construction is within 300 feet of the ordinary high-water mark (OHWM) of Squaw Lake The proposed detached garage meets the]5-foot setback to the OHWM The setback shall be measured to the closest point of the structure pursuant to Ch 16.3151.a • The proposed structures meet the setbacks to the property lines and maximum 25-foot height requirement for accessory structures pursuant to Ch 152312 The replacement above -grade stairway and patio are proposed within the same footprint asthe existing stairway/patio and are located entirely within the 35-foot vegetative buffer zone • The ezistmg wooden stairway and patio wall be replaced with concrete and remain a<or above grade • The total lmpereaus surface calculation within 300 Net of the OHWM resulted in 56% Mitigation is not required pursuant to Wis.
