Community Development staff have reviewed the application to reconstruct an attached deck at
the existing residential structure at 288 Cave Road pursuant to the St Croix County Plura lain
Overlay Olrtnct, Chapter 17 40 The request has been conditionally approved based on the
application submission and the following findings
The structure Is located within a mapped Special Flood Hazard Area (SFHA) on the Hood insurance
Rate Map (FIRM), Panel 27163CO369E with an effective date of January 3, 2010
The Regional Flood Elevation (RIFE) for the Lower St. Croix River, Lake St Croix, Is known (6920')
The construction of a deck that does not exceed 2Oo square feet, adjacent to the exterior wall of
the principal structure is not an extension, modification or addibon
Modification to a nonconforming structure, which over the life of the structure would not equal or
exceed 50%of its present equalized assessed value is allowed within a land use permit per Ch T] 4
H1 b) and Ch. 174 H.2.
Based on these findings, approval of the Land Use Permit is subject to the following conditions
The cost of the modification of the upper deck beyond 200 square feet, equates to 228%of the
present qualued assessed value of the structure Therefore, over the life of the mucture only
47R%may be permitted as a modification or addition Once the modification or addition equates
or exceeds 50%, then the entire structure would need to be permanently changed to a conforming
structure in compliance with the Floodplain Zoning Ordinance.
The at -grade patio footprint will not be expanded beyond the existing footprint or increase in height
No material may be deposited that is classified as a solid or hazardous waste material and must be
protected against erosion per Ch t] 4 F 3 d
Floodpmofing measures shall be designed and implemented per Ch. 17 4 D 5.

Failure to comply with the terms or conditions above may result in the revocation of this permit by
the Zoning Administrator pursuant to Ch 1771

This permit Is valid for one year, with the possibility of up to two (2) six month extensions if the
applicant submits the appropriate permit extension documentation to the Zoning Administrator A
copyof the Land Use Permit placard should be submitted to the town's local Building Inspector upon
applying for town building permit(s). The orange placard must be posted on the3ob-sne and "be
from public view.
