PLANNING AND ZONING COMMITTEE

February 12, 2008

Call to Order: Chair Habhegger called the meeting to order at 8:33 a.m.
Adoption of Agenda: Motion by Burri, 2nd by Troyer to adopt the agenda. Motion carried.
Approval of Previous Minutes: Motion by Burri, 2nd by Troyer to approve the minutes of
January 8, 2008. Motion carried.
Date of Next Meeting: A hearing for one rezoning will be held on Tuesday, March 5, 2008 at
7:00 p.m. in Baldwin.
Old and New Business:
Land Use Ordinance Applications
Municipal Plats —Alex Blackburn presented the plat of Baldwin Business Park in the Village of
Baldwin. Motion by Troyer, 2nd by Burn and carried to certify no objection to the plat of Baldwin
Business Park in the Village of Baldwin, stipulating that no opinion is expressed concerning
adequate sewer service.
Waivers and Rezones to be Scheduled — none
Discussion of Plats and GSM's currently in the review process — Blackburn distributed and
reviewed the list with the Committee as well as corresponding Technical Review Committee letters.
Planning and Zoning Business:
Bills and Revenue - The January 2008 Planning Bills and Revenue Reports and the January 2008
Zoning Bills and Revenue Reports as well as the September 2007 Zoning Bills and Revenue
Reports were reviewed by Committee members. Motion by Burri, 2nd by Troyer to approve.
Motion carried.
Personnel Update - Dave Fodroczi announced that we have contracted with Anna McCabe as the
new Recycling Assistant. She will work with five other counties in western Wisconsin to expand
recycling in area businesses and to expand and monitor the school and apartment recycling
program. The position is funded by the counties and through Recycling Efficiency Grant funds.
Carrie Stoltz has accepted the position of Water Regulation and Zoning Specialist for the DNR in
the Baldwin office. We are accepting applications for her replacement through February 25. The
office manager position has actually been accepted in the negotiations with the union. The process
is waiting final agreements on similar positions in other departments. The final resolution should
come in the near future.
Fodroczi reported that all positions in the entire county have been going through a new Springsted
evaluation. All employees filled out Position Analysis Questionnaires in January that are being
reviewed by departments after which they will be processed with the consultants.
Office Remodeling - Fodroczi reported that it has been determined that Room 1259 will be used
by the Victim Witness program. It may be possible to relocate the EDC staff to the area that is a
current storage room adjoining the IT department. He met with Art Tobin and other building
services staff. Tobin is working with Corporate Express in determining what materials are on hand
and what is needed to put a long term plan in place.
Lake Mallalieu Dam Agreement - Fodroczi presented and explained the agreement. The
Hudson Area Intergovernmental Council has reviewed the issue of the dam maintenance. The
agreement addresses the budgeting aspect of it. If any costs in excess of $11,000 are incurred in a
calendar year, they will need approval of each municipality. Motion by Troyer, 2nd by Burri to
approve the Lake Mallalieu Dam Agreement. Motion carried.
Planning Report — Ellen Denzer reported that the bike planning public information meeting on
January 31 went very well. Only a few minor changes were suggested by those in attendance. The
final version should be presented for adoption by the County Board in March. The Town of Star
Prairie is working on its land use section. A visual preference workshop will be held in late March.
Pete Kling is organizing that workshop. The project should be complete by early summer. Denzer
is expecting a state grant for the Star Prairie planning project. The Town of Somerset asked for a
review of the draft of its subdivision ordinance. The Town of Stanton has also requested assistance
with its land division and driveway ordinances.
Recycling Program and Ordinance Review - Jennifer Havens showed the presentation that was
done at the public information meeting on January 31. The presentation covered recycling rules and
regulations — state and county ordinances; the St. Croix County program; recycling program and
ordinance issues; reasons for changes to ordinance; required ordinance changes; resident issues;
hauler issues; municipal issues; and a timeline for adoption of amendments. She noted that the
county ordinance has not been updated since 1994. She asked for feedback and recommendations
from the Committee members. Committee members agreed that area fire chiefs should be invited to
that meeting. Another public information meeting will be held on March 13.
Code Administration Report - Kevin Grabau reported that he has been receiving calls and
reports on code enforcement issues. With the vacancy of the code enforcement position, Ryan
Yarrington is helping with response letters and site inspections.
Grabau gave an update on what staff is doing in response to the two administrative appeals
discussed at the last meeting. Staff has met and looked at some ordinance changes in the Shoreland
District as recommended by the Committee and is reviewing how applications are processed. He
will bring proposed amendments back to this Committee next month.
Report on Bettendorf Legal Proceedings - Corporation Counsel — Greg Timmerman reviewed
the case and reported on its current status. The case went to the Court of Appeals. The decision of
the Circuit Court was reversed. It came back and Timmerman submitted a revised judgment to
Judge Needham for signature. Bettendorf s attorney and he argued about whether that was
appropriate. The Court of Appeals reversed the Circuit Court's decision. When Timmerman
drafted the new order he reversed what the judge found and Judge Needham signed that order. That

should have ended the case, except that within 45 days Timmerman received a notice of appeal
from Bettendorf s attorney again. He is alleging that the Circuit Court decided one issue, but there
are several issues left to be decided which the circuit court refused to do after the Court of Appeals
reversed the Circuit Court decision. Timmerman filed a motion with the Court of Appeals to
dismiss the action because there is nothing to appeal. That motion was denied. Now he is briefing.
They have taken the position to read the briefs and decide after the briefs are filed and not look at it
before that. The Bettendorf brief was received the previous week with 30 days to respond. It
makes arguments that are not factual. It makes arguments that the Circuit Court didn't decide
certain issues. The Court of Appeals didn't address these issues. The issues are exactly what the
Court of Appeals decided. Timmerman does not understand the reason for this new appeal.
Land Information Report — Brett Budrow reported that the Local Update of Census Addressing
(LUCA) program is underway comparing our address lists with the Census address lists to make
sure the Census has complete and accurate addresses. He sent the Census our roads and centerlines
previously and other features so they could increase the accuracy of their data. They were not able
to update their data spatially. It causes some issues when we compare our addresses with their
addresses and locate them in the correct census block and census track. We are doing upgrades of
software and hardware for GIS servers for public use as well as internal clients. Our website has
not been updated for three or four years.
Budrow has been providing GIS data to the company that is producing new plat books. By
receiving updated data this way the company will be able to produce updated books more
frequently.
Real Property staff met with City of Hudson staff on January 17 to go over the processing of City
documents. The final imports and test for real estate for 2008 were done. Only two parcels came
through with errors. Staff is now doing daily work for 2008 real estate and processing new year
transactions for 2009. Staff adjustments will be made as needed.
