REV!EW:
The Zoning Administrator will review the application for completeness and assign a file number to the
application. The Zoning Administrator may require additional information and will notify the applicant of this
within 10 days. Upon receiving a complete application and supporting documents, the Zoning Administrator
will:o send copies of the applications to the appropriate reviewing agencies for comment. Appticants are
encouraged to contact thdr town to discuss their application and inquire about necessary
building petmits and approvals at the town level;o schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable
property/project corners and label the flags accordingly; ando review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval,
the permit will be mailed to the applicant or to the applicant's agent.
lf approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant
may also be required to apply through the Town for a local building permit. All site plans, pictures, and other
materials submitted with the application become the property of the Community Development Department
and will remain in the file.

The project will include the construction of a garage addition on an existing parcel located in the shoreline district.
Approximately 1,500 sqft of the existing driveway area will be disturbed to accommodate construction. Notreeswill be
removed within 75 feet of the OHWM. A newmound system was installed in the springof2020 and no changes are
proposed. The applicant is currently reviewing cost proposals and it is possible that construction might not start until
next spring depending upon weather and contractor availability, The landowner will serve as the general contractor.

Community Development staff have reviewed the Land Use permit application for the addition of
an attached garage to an existing nonconforming structure within a Shoreland Overlay District,
pursuant to Chapter 16.330.5. The request has been conditionally approved based on the
application submission and the following findings:
o The conditionally permitted structures are proposed in the Town of St. Joseph, within a
Shoreland Overlay District.
. Proposed construction is within 300 ft of the ordinary high-water mark (OHWM) of a
navigable pond, Perch Lake.
. The structure will be under the maximum height of 35 feet.
. Structure setbacks and standards will be regulated by the Town of St. Joseph zoning
authority.
. The proposed addition meets the 75-foot setback to the OHWM. The setback shall be
measured to the closest point of the struciure pursuant to Ch.16.315.1.a.
. All proposed development will be located outside of the Zone A floodplain boundary per
FEMA map panel #55109C0187E.
. The total impervious surface calculation within 300 feet of the OHWM resulted in 12.5o/o
therefore mitigation is not required pursuant to Wis.Stat.59.692
. The proposed land disturbance will not affect slopes greater than 12o/o.
. Erosion and sediment control plans have been submitted and meet Wisconsin Department
of Natural Resources Technical Standards. Best management practices will be incorporated
Based on these findings, approval of the Land Use permit is subject to the following conditions:
1. Prior to Construction, erosion control measures, such as silt fencing must be installed prior to all
land disturbance activity.

\,2. A pre-construction inspection is required to validate setbacks and verify the installation of erosion
control. Please call me at (115) 3864676, to schedule this inspection.
3. St. Croix County reserves the right to require additional sediment and erosion control measures to
be installed if found necessary due to site-specific concerns and will be documented in an as-built
site plan.
4. All temporary erosion control measures shall be Ieft in place and maintained until the site has reached
a point of at leastTOo/o permanent vegetation. Permanent vegetation shall be established once final
grade is reached or as soon as applicable per plan.
5. A post-construction inspection is required prior to removing the temporary sediment and erosion
control measures to verify proper vegetation cover has been established. Please call me at
(115) 386-676, to schedule this inspection.
6. The Department of Natural Resources shall be contacted for a NR 216 permit if land disturbance
equals one acre of greater in size.
7. lt is the applicant's responsibility to secure any other required local, state or federal permit(s) and
approval(s) prior to land disturbance activity.
8. Failure to comply with the terms or conditions above may result in the revocation of this permit by
the Zoning Administrator pursuant to Chapter 16.570.1.

permissions are required. This permit is valid for one year, with the possibility of up to two (2) six-
month extensions if the applicant submits the appropriate permit extension fee and documentation
to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the
town's local Building lnspector upon applying for town building permit(s). The orange placard must
be posted on the jobsite and visible from public view.

Attached is a revised plan set that includes a note about using a temporary berm or filter sock to protect the existing
rain garden and a note about the Town ofSt. Joseph Zoning authority. lcould just take the setback line ofi but lthink it
may be better to leave it there and just make a note about the Town zoning authority. lt appears from their website
that the Town will be utilizin8 the County's Zoning ordinance until they can prepare a new one. Therefore, the 50'
setback would still be applicable...albeit enforced by the Town instead of the County. ln regards to the existing rain
garden, there shouldn't be much of threat because there is very little disturbance outside of the new footprint and the
grades are very minimal. lt shouldn't take much effort to prohibit sediment from entering the existing rain
garden. Please let me know if you would like any other changes or would like me to drop off some paper copies. Have a

I am reviewing the Land Use permit submitted for the property at 13M 53'd St. and just have a couple quick
questions:
. There's a small shed shown on the site plan just outside of the mound system; looking through previous
correspondence it seemed like there was talk of this shed being removed or replaced at a different
location on the property? lf removed, could you provide an updated site plan?
. ls the rain garden shown on the site plan existing or shown as an example?
. The Town of St. Joseph is no longer under county general zoning jurisdiction, so the 50' setback to the
roadway is no longer applicable by county zoning. lf possible, could this be removed from the site plan?

only a few comments:
o Floodplain - Zone A, therefore BFE is unknown, but please overlay the approximate boundary on the final
site plan as per FEMA flood panel map #27163C0300E. Roadway setback - close, confirming this is the overhang?. Well - is this location known?
' lmpervious Surface calculation - does the new lS conclude 13.4%? ls that correct? Or, is the garage going
over existing lS (say, pavement) and so then this would not change?. Total amount of disturbance?

Attached is a sketch of a proposed garage addition to an existing non-conforming house. Because the addition will
conform to all setbacks we are assumint that a land use permit is possible. Before the landowner has a contractor start
figuring out some of the construction details can you give us your initial reaction and let me know if you see any major
concerns. I also still need to complete some fieldwork to make sure I fully account for all impervious areas, but it
