R�.J►9, �'w '° �..1NTY RESOLUTION AMENDING PERSONNEL POLICIES FOR PERSONAL 1,I'SOYI`'1)7 LEAVE, FMLA, EMPLOYEE BENEFITS COVER MEMO TO: County Board of Supervisors FROM: Ken Witt, Interim County Administrator DATE: January 5, 2021 AGENDA ITEM: Resolution Amending Personnel Policies for Personal Leave, FMLA, Employee Benefits BACKGROUND INFORMATION Family and Medical Leave Act Policy Proposed Changes Current policy, of the same title, is located in Article 17 of the Human Resources Policies and Procedures Handbook • 2.11.1 Policy: Added Statement • 2.11.7 Application for Leave: Added this section • 2.11.8 Certification by Health Care Provider: Added reference to apply for leave with the County's third-party administrator. • 2.11.11 Compensation During Leave: Removed specific types of paid time and replaced with a broader statement of"any accrued paid time". • 2.11.11 Compensation During Leave: Added language regarding the use of paid time if the employee is receiving other paid benefits. • 2.11.12 Continuation of Benefits: Removed specific reference to health insurance and replaced with "all group insurance benefits". • 2.11.12 Continuation of Benefits: Added language regarding paying premiums during unpaid leave. Personal Leave of Absence Policy Proposed Changes Current policy of the title, Unpaid Leave, is located in Article 10-16 of the Human Resources Policies and Procedures Handbook • 2.19: Updated Title from Unpaid Leave to Personal Leave of Absence 0 2.19.1 Policy: Added Statement • 2.19.2 Purpose: Added Statement • 2.19.3 Definitions: Added Definitions • 2.19.4 Eligibility: Updated eligibility language from 20 hours or more per week to active regular full-time and regular part-time employees. Temporary and on-call employees are not eligible • 2.19.5 Compensation: Added language requiring the use of paid time off before unpaid time can be taken. • 2.19.6 Benefit Status: Removed language regarding benefit continuation in accordance with 101"/111" day rule and replaced with language regarding COBRA and portability eligibility beginning at the end of the month after last day in active pay status. Employee Benefits Policy Proposed Changes Current policy of the same title is located in Article 10 of the Human Resources Policies and Procedures Handbook • Chapter 3-Policy: Added statement • Chapter 3-Purpose: Added statement • Chapter 3-Definition: Added definitions • Chapter 3: o Removed all language and sections related to Leave of Absences, PTO, LTSB, Holidays, and Work Related Injuries or Illnesses; Added this removed language to the new Time at Work and Away from Work Chapter. o Removed Social Security Section o Removed Unemployment Compensation Section o Removed United Way Payroll Contributions section • 3.1 Benefit Eligibility& Enrollment: o Updated eligibility language to 30 or more hours per week (with exception of WRS, Health &Wellness Reimbursement, and Supplemental Benefits) o Removed language regarding social security (FICA) and Worker's compensation and liability insurance o Modified language regarding elected officials to make the policy easier to read o Removed language regarding Part-Time I and Part-Time II o Moved language regarding WRS eligibility to 3.5.1.1 WRS Eligibility o Removed Pro-rated Benefits for Part-time employees' section and added language regarding PT benefits to 3.1.1.1 Hours Requirement • 3.1.1.3: Added Contribution section • 3.1.2: Added Enrollment section • 3.2 Health, Dental, and Vision Insurance: o Removed Retiree Health Plan Language o Removed "Health insurance while on unpaid leave" section; Add details to the leaves of absence policy instead o Removed "Payments to Finance Department" section; Add details to the leaves of absence policy instead • 3.3 Life Insurance: Removed specific language about life insurance options (1x, 2x, 3x, $5000-$25,000) and replaced with vague language so that changes to plan design can be made without having to re-write the policy • 3.4 Flexible Spending Account: added this section • 3.9 Employee Assistance Programs: o Removed current EAP section - this may be moved to Performance Review policy o Added new EAP section Resolution No. 3 (2021) ST. R�.J►9, �'w '° �..1NTY RESOLUTION AMENDING PERSONNEL POLICIES FOR PERSONAL LEAVE, FMLA, EMPLOYEE BENEFITS 1 WHEREAS, on September 2, 2014 St. Croix County adopted the current version of the 2 St. Croix County Personnel Policies and Procedures Handbook; and 3 4 WHEREAS, the handbook was further amended in 2015-2020; and 5 6 WHEREAS, the Staff Advisory Committee and Department Heads have been provided 7 copies of the updated policies for review; and 8 9 WHEREAS, on December 15, 2020 the Administration Committee has reviewed the 10 amendments and recommends approval to the St. Croix County Board of Supervisors. 11 12 NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board of 13 Supervisors that the St. Croix County Personnel Policies and Procedures Handbook is hereby 14 amended as follows: 15 16 Create Section 2.11 Family and Medical Leave 17 18 Create Section 2.19 Personal Leave of Absence 19 20 Create Chapter 3 Employee Benefits Legal-Fiscal-Administrative Approvals: Legal Note: Fiscal Impact: No fiscal impact.
