To whom it may concern,
Community Development staff have reviewed the Land Use Permit application for the construction
of a single-family dwelling,driveway, and POWFS within a Shoreland Overlay Dialect Therequest
has been conditionally approved based on the application submission and the following findings
• The conditionally permitted structures are proposed in the Town of Rhchmord, within a Shoreland
Overlay Dastnct
• The proposed land disturbance is within 300 feet of the ordinary high- water mark (OHWM) of
Brushy Mound Lake The OHWM of Brushy Mound Lake is 976
• The proposed structures meet the]5-foot setback to the OHWM. The setback shall be measured
to the closest point of the structure pursuant to Ch 16 3151 a
• The proposed structures meet the setbacks to the property Imes and maximum 35-foot height
requirement (principal structure)
The proposed land disturbance will not affect slopes greater than 12%
• The structures and land disturbance are proposed outside the floodplam limits The Regional
Flood Elevation is 977 3
• The proposed dwelling meets the Lowest Building Opening elevation of 9831.
• The total impervious surface calculation vathin 300 feet of the OHWM resulted in 95% Mitigation
is not required pursuant to Was Stat 59692
• Erosion and sediment control plans have been submitted and meet Wisconsin Department of
Natural Resources Technical Standards Best management practices will be incorporated
• A sanitary permit application was submitted on January 6, 2021 and is pending approval.
Based on these findings, approval of the Land Use Permit is subject to the following conditions
