CROIX COUNTY GOVERNMENT CENTER, HUDSON WI November 10, 2008 Present: Committee: Supervisors Gene Ruetz, Lorin Sather, Sharon Norton - Bauman Absent: Steve Hermsen, Peter Post Staff. Dave Fodroczi, Kevin Grabau, Ellen Denzer, Alex Blackburn, Kay Walsh, Judy Olson Call to Order: Chair Ruetz called the meeting to order at 8:35 a.m. Adoption of Agenda: Motion by Sather, 2 by Norton -Bauman to adopt the agenda. Motion carried. Approval of Previous Minutes: Motion by Sather, 2 by Ruetz to approve the minutes of September 24, October 14 and October 29, 2008. Motion carried. Date of Next Meeting: A comprehensive planning kick -off meeting is scheduled for November 11 at 7:00 p.m. at WITC in New Richmond. Next regular Committee meeting will be held on December 9, 2008 at 8:30 a.m. in Hudson. Old and New Business: Land Use Ordinance Applications Municipal Plats - none Waivers and rezones to be scheduled - Three rezoning applications were received and will be scheduled for public hearing on December 17, 2008 at 7:00 p.m. in Hudson. Discussion of Plats and CSM's currently in the review process - Blackburn distributed and reviewed the list of last month's submittals as well as corresponding Technical Review Committee letters. He noted some issues with one CSM in the Town of Erin Prairie. Planning and Zoning Business Bills and Revenue Reports - The October 2008 Planning Bills and Revenue Reports and the October 2008 Zoning Bills and Revenue Reports were reviewed by the Committee. Motion by Sather, 2nd by Norton -Bauman to approve. Motion carried. Suite Remodeling - Fodroczi reported that the suite remodeling was approved by Finance Committee. He has met with Corporate Express about the schedule. Corporate Express will meet with Building Services this week to determine the sequence of moves and activities before beginning work. Four staff moves will begin immediately. Building Services will then begin the teardown of existing walls and plan the remaining moves. The goal is to complete the project by year's end. 2009 Waste Event Schedule and Contracts - Fodroczi stated that one item has not been received yet so this will be scheduled for the December 9 meeting. Recycling Ordinance Review - Fodroczi stated that there is nothing new to report. All previous Committee questions were answered at the October meeting. There have been no ordinance review comments or questions from Corporation Counsel since then. Norton -Bauman stated that she would like to use outside counsel for this project. Motion by Norton - Bauman to request outside counsel to do legal review of the recycling ordinance amendments. Motion 2nd by Ruetz. Fodroczi confirmed that the ordinance was submitted for review in July with a preliminary indication that the review could be completed by the Committee's October meeting. Subsequent correspondence to the Committee indicated that the October timeframe was not achievable. Sather stated that the proposed ordinance is more complex than the existing one. Norton -Bauman agreed, but each month there is no indication of progress from the Corporation Counsel office. We cannot establish a timeline or schedule hearings. It was originally planned to have the ordinance ready for implementation on January 1, 2009, which would be best for haulers for their annual reporting. We just need some information as to when things will happen. Ruetz noted that if the motion passed there will be a period of time for Finance to look at this request. During that time we can get information as to when in -house counsel can provide information. This would need to be presented to Finance Committee for approval on December 4th. Ruetz moved to amend the motion to include "depending on outcome of discussion with Corporation Counsel with date certain by which we will receive some activity." Motion 2 °a by Norton - Bauman. Fodroczi stated that costs for this project are covered by the recycling efficiency grant. It may not require use of County funds. Motion to amend carried. Motion carried. Sather opposed. Comprehensive Plan Update - Denzer stated that most groups will attend the kick -off meeting on November 11 at WITC in New Richmond. Alicia Cosgrove from UWRF and Pete Kling will give an overview of the project. Cosgrove will cover comprehensive planning and answer questions. An interactive group exercise will take most of the time. Denzer stated that she expects that most of the citizens advisory committee members will participate in the kick -off meeting. The Deer Park survey received a 50% return rate. 188 surveys were mailed out. The County survey needed 388 returns, a representative sample, and 453 were received. The Town of Richmond also had a good return with 500 out of 1024 returns. 282 returns were needed. Surveys were sent to every household in the Town. There will be some additional cost in processing the surveys because of this exceptionally high return rate. Code Administration Report - Grabau reported on Sukowatey and the Bettendorf non- metallic mining violations. He is working with Don Gillen getting direction then will move ahead. He is verifying photos of the property now and before. Part of the exercise in getting the place cleaned up is determining all that is junk. He has heard nothing from Bettendorf since the public hearing. He has started a letter to Bettendorf on outstanding issues and the need for permits which he will send this week. Adjustment to Rezoning Fees for Austrums - Grabau stated that when additional items are brought to the Board of Adjustment the fee is incorporated in the same report. Rezoning applications are separate and more work goes into rezoning applications that are similar than one single application. They are heard separately, require separate staff reports and separate resolutions for County Board approval. More work goes into rezonings that are similar for the same project than just adding something for Board of Adjustment. For these rezonings both are included in the same ad so it may be fair to adjust fees for the cost of the ads, such as the first one at full price and the second at half price. He noted that there will be a similar situation for the rezoning applications just received that will be scheduled in December. Sather felt these 2 should be dealt with on a case to case basis. Some of the fees should be refunded since the applicants did request it. Norton -Bauman stated concern with setting precedence. Motion by Sather to refund %2 of the second fee - $550.00 to Sharon Austrum. Motion 2 by Ruetz. Fodroczi asked that the Committee recognize as part of the approval that this was a sale between adjoining landowners. The rezoning was required to make the zoning consistent because the two adjoining parcels were in different districts. It is coincidental to see another similar application so soon. Motion carried, Norton -Bauman opposed. POWTS Fees - Grabau explained that the State Department of Commerce has changed two of the POWTS program permit provisions effective December 1 The State has increased the State portion of the State sanitary permit by $25.00. The State will now be reimbursed $100.00 for every State sanitary permit that is issued, up from the present $75.00. Secondly, the holding tank reviews will no longer be done by the State. The County will assume that responsibility. The State currently charges $60 for the plan review. Grabau suggested that an additional $50 would be reasonable to cover the plan review. Motion by Norton -Bauman to approve the $25 increase in POWTS fees to be sent to the State as part of the fee schedule and also approve the additional $50 fee for holding tank approval. Motion 2 by Ruetz. Norton -Bauman stated that the County should not subsidize additional fees by the State. This is a pass - through increase to the State. Motion carried. Sather opposed. Register of Deeds Resolution to Charge for Rental Weatherization Stipulation & Waivers - Walsh stated this program has been in place since 1985. The Register of Deeds did not choose to charge a fee at that time. The Department of Commerce has discontinued the practice of reimbursing the County $5 for each validation. Since the State changed its practice in May 2008, the Register of Deeds Association suggested that counties charge a $20 fee for this service. Several neighboring counties are already doing this. She talked to Greg Timmerman who said the resolution needs to come from the Committee. Walsh has validated 24 to date this year. Motion by Norton -Bauman to charge $20 for Rental Weatherization Stipulation and Waivers to be paid to the Register of Deeds Office. Motion 2nd by Sather and carried unanimously. Report of a new service to County Property Owners - Walsh reported on a new service that the Register of Deeds Office will be offering to county property owners soon. It is called Property Fraud Alert, which is tied in with the Fidlar software. The FBI says that property and mortgage fraud is the fastest growing white collar crime. This service is designed to monitor, identify and notify individuals whose name has been indexed from a document recorded in the Register of Deeds Office. The intent is to allow property owners the ability to have their personal/business name monitored within the County Register of Deeds Office in order to track possible fraudulent activity. Property owners will be notified only when the name they have submitted is used in any recording activities within the County Register of Deeds Office. The alert notification methods will be by email or phone whichever the land owner selects at the time of subscription. There is no fee to subscribe to this service. The department is being proactive. It has already been implemented in three other counties in Wisconsin plus several counties in other states. There have been no instances in Wisconsin yet, but there have been some in Illinois, California and Florida. Walsh will do publicity on this new service 3 Announcements and Correspondence - Fodroczi stated that he reviewed an email sent to Jennifer Havens commending the County website for its excellent information about the recycling and special waste programs.
