Dear Mr. Harsdorf; This letter confirms zoning approval for a Construction Permit according to the plans you have submitted for an animal waste storage facility at the location referenced above. Staff finds that the proposed project meets the requirements of the St. Croix County Animal Waste Storage Facility Ordinance and the St. Croix County Zoning Ordinance with the following findings: 1. An animal waste storage facility is subject to the Animal Waste Storage Facility Ordinance and Zoning requirements. 2. An animal waste storage facility is allowed with a land use permit pursuant to Section 11.3 A. of the St. Croix County Animal Waste Storage Facility Ordinance. 3. The proposed storage facility is in an unzoned Town and is not subject to the setbacks in section 17.12 (14) of the St. Croix County Zoning Ordinance. 4. The applicant submitted a manure storage facility plan that includes; engineered plans, operation and maintenance plan, soil logs, construction inspection plans, construction specifications, grading plans and erosion control plans. 5. The proposed manure storage facility is not located in a floodplain or shoreland area. 6. The Community Development Department, Resource Management Division has reviewed the information listed under 44 and recommends conditional approval of the land use permit. 7. The proposed animal waste storage structure complies with the standards in Section 11.2 A. of the St. Croix County Animal Waste Storage Facility Ordinance. Based on these findings, approval of the land use permit is subject to the following conditions: 1. The applicant shall provide an as -built drawing of the constructed animal waste storage facility signed by a professional engineer. 2. The applicant shall obtain an operation permit from the county prior to use of the structure. 3. The applicant shall submit annually a certified 590 nutrient management plan for the operation. The applicant shall remain in full compliance with Wisconsin Administrative Code ATCP 50 and NR 151. 5. Any modifications require approval from the Code Administrator. 6. Upon transfer of ownership a written notice shall be submitted to the Zoning Administrator. 7. This permit is valid for one year. A request can be made for one additional year. 8. If this operation ceases operations for a period of 24 months this pit shall be closed according to 11.3 E of the Animal Waste Storage Facility Ordinance. 9. The owner shall give five working days' notice to the Community Development Department prior to starting construction. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including obtaining a building permit from the Town of Cady.
