The electrical wiring for the pump and alarm are now properly connected and a code - compliant junction box has been installed. 3. The dose tank cover has been raised to meet the minimum 4" above grade and the vent inserted in the cover is now 12" above grade. The cover has a locking device. While taking pictures, I observed a & damaged electric junction box and wiring running into a manhole cover at the base 71 P of a brick patio and stairs. Apparently after the Private On -site Wastewater 71 6 -4674 Treatment System ( POWTS) was installed in 2005, the retaining wall and brick patio were built over the top of the septic tank and part of the dose tank. Leroy Property Jansky, Dept. of Commerce Wastewater Specialist, inspected the POWTS on May - 386 -4677 12 th and confirmed several code violations are present. Recyc Based on the sanitary permit's site plan and inspection record, the existing patio 715 -386- fire ring appears to be on top of one of two concrete manhole covers for the septic tank (I have enclosed cross - section drawings for your review). Per Comm 83.54 (3), the tank(s) must be accessible for required servicing and inspections and Comm 83.52 (1) holds owners of POWTS responsible for ensuring proper operation and maintenance of their wastewater treatment systems. There is no record that the tanks have ever been serviced. Luckily, the Dept. of Commerce doesn't consider the patio a "structure" that has to meet minimum setbacks; the deck and house meet the minimum 5' setback to the tanks per Comm 83.43 -1. The following compliance activities are required: 1. Debris from the fire ring must be removed to see if the cover on the manhole can be opened. If so, then arrange for the septic tank to be cleaned out by a certified sewage pumper and have both the septic and dose tanks inspected. If the effluent filter, which is normally connected to the outlet of the tank, is not accessible for cleaning and maintenance, the brick patio will have to be altered to gain access to the manhole. Please note on the septic tank diagram that the filter access opening must extend at lea 4 least inches above grade with a locking device for the cover. 2. Todd Featherstone did the original installation, but any of the qualified plumbers ay do the work. The pump should be tested and confirm that the floats are set at elevations in approved design, which is on file here at the zoning office. 3. Th tank cover must be raised to meet the minimum 4" above grade and the vent inserted in t er must be 12" above grade. The cover must also have a locking device as shown in the sed diagram. Finish grading had not been completed at the time of the POWTS insp ns in 2005. 4. Only t ee of the required four (4) observation pipes are visible on the dispersal cells. As per state stats 101.12(2), nothing in this review shall relieve the designer of the responsibility for designing a safe building, structure, or component. The applicant is Anne Rolland, 1045174 Street, Hammond, WI 54015, with Eric Rolland and James Filkins aging as her agents. 5. The site is located off of Highway 35 at Government Lot 2, Section 35, T30N -R20W, Town of St. Joseph, St. Croix County, Wisconsin. 6. The applicants filed an application with the Planning and Zoning Department for variance to construct a home within the setback of Highway 35, a Class B Highway, and an application for a variance to do grading and filling within slopes greater than 12 percent in the St. Croix Riverway District in order to install a septic system drainfield. 7. The Board of Adjustment finds that the requirements have been met to grant a variance for the variances pursuant to Sections 17.64(1)(b)2,17.36(5)(1)l.b and 17.70(5)(c)3 of the St. Croix County Zoning ordinance. 8. The applicants have worked with the St. Croix County Land and Water Conservation Department, Planning and Zoning Department, and Wisconsin Department of Natural Resources to address their concerns and have agreed to conditions suggested by these departments and agencies. 9. The Wisconsin Department of Transportation does not object to granting the variance and has confirmed that the Rolland property will not be impacted by any future improvements or realignments to Highway 35. 10. The applicants have submitted and agreed to abide by a geotechnica . engineering report with recommendations and construction considerations for the proposed construction. 11. The Board finds that the strict application of the Ordinance would create an unnecessary hardship due to the absence of any buildable area on the lot. 12. The Town of St. Joseph has recommended approval of the highway setback variance request. The Town of St. Joseph Planning Commission has recommended approval of the variance for the drainfield 2 to the Town Board, which will meet in January 2005. 13. There was no public opposition to the requests. 14. The Board finds that, with conditions, the request is not contrary to the public interest. 15. The Board finds that, with conditions, the spirit and intent of the ordinance would be met by granting the request for the variances, and substantial justice would be done. D On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved the applicant's variance requests to encroach within the Highway 35 and to install a septic system dminfield on slopes greater than 12 percent in the St. Croix Riverway district, with the following conditions: 1. The applicant must obtain a permit for the proposed sanitary system approved by the State of Wisconsin and the St. Croix County Planning and Zoning Department. 2. The variance for the drainfield is contingent upon receiving no objections from the Town of St. Joseph at its Town Board meeting in January 2005. 3. These variances are for the home and drainfield as shown in the plans submitted to the Planning and Zoning Department on December 2, 2004 and do not include additional decks, patios, rches walkways or Lm other accessory res mIrripwaM Qgymge not shown on the r plans The applicants shall be required to apply for and obtain a variance prior to construction or any additional structures. 4. The applicant must secure a township building permit before commencing home construction and a permit for driveway access off of State Highway 35 from the proper agency. 5. The proposed home must be earth tone in color to blend in with the vegetation and geologic features present on the site. 6. Prior to commencing construction, the applicant must submit to the Planning and Zoning Department the following information requested by the Land and Water Conservation District in its e-mail dated December 9,2004: • Route of stormwater overflow (prove it will not flow over POWTS). • Plan showing an additional row of silt fencing around all disturbed areas. 7. Prior to commencing construction, the applicant shall submit and have approved by the Planning and Zoning Department and Land and Water Conservation Department a revised landscaping plan that includes a mix of native trees, shrubs, and grasses endemic to the south- facing slopes in the area. Native trees should include fast - growing poplar hybrids and slower growing red oaks. They must be planted in a manner that fully screens the home as viewed from all directions during summer leaf -on conditions, and to secure the slopes from erosion. Planting must be done within 60 days of completing construction of the home and drainfield. 3 8. The applicant must record the stormwater and erosion management plans against the deed for the property. The applicant is responsible to provide an as -built drawing showing all permanent structures and drainage easements along with a recorded copy of the deed to the Planning and Zoning Department within 60 days of completing construction. The intent is to make the current and future owners aware of the responsibilities associated with the plans as well as the limitations incurred as a result of the plans. S. The applicant shall follow the recommendations and construction considerations in the geotecimical engineering report prepared by GN E Consultants, Inc. and submitted to the County on December 4, 2004. The applicant shall ensure that all contractors working on this project have read the report and have signed a written statement verifying this. Signed statements from an contractors must be submitted to the Planning and Zoning Department prior to beginning 0005trwtion. This is intended to protect the applicant's house and dminfreld from slope failure and future erosion problems. 9. The applicant shall install a monitoring port to ensure that the drywell is maintained and functioning properly. 10. The applicant shall submit to the Planning and Zoning Department photographs of the home and landscaping as viewed from the river within 60 days upon completion of the construction. 11. Any minor addition or change in to the plans presented for variance shall require review and approval by the Planning and Zoning Department prior to making the addition or change. Any major addition or change to the originally approved variance will have to go through the variance process. 12. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. As part of this permit, Ms. Quinn is requiring that you sign an erosion and sediment control plan prior to commencing construction, and we recommend that you work closely with her to ensure that proper erosion and sediment control measures are installed and maintained on your property throughout the duration of the construction. We have found that the following conditions have also been fulfilled: • Condition #2 has been fulfilled with a vote for approval by the Town of St. Joseph Town Board on January 6, 2005. • Condition #6 has been fulfilled with revised erosion and surface overflow plans submitted by James Filkins on December 28, 2004. Prior to commencing construction, you must fulfill the following outstanding conditions: • Per Condition #4, you must obtain a Building Permit from the Town of St. Joseph. • Per Condition #7, you must submit and have approved by the Planning and Zoning Department and Land and Water Conservation Department a revised landscaping plan that includes a mix of native trees, shrubs, and grasses endemic to the south - facing slopes in the area. Native trees should include fast - growing poplar hybrids and slower growing red oaks. Tank inspections must include a visual inspection of the tankls) to identify any missing or broken hardware, identify any cracks or leaks, measure the volume of combined sludge and scum and to check for any back up or ponding of effluent on the ground surface. The dispersal cell(s) shall be visually inspected to check the effluent levels in the observation pipes and to check for any ponding i of effluent on the ground surface. The ponding of effluent on the ground surface may indicate a failing condition and requires the immediate notification of the local regulatory authority. When the combined accumulation of sludge and scum in any tank equals one -third W or more of the tank volume, the entire contents of the tank shall be removed by a Septage Servicing Operator and disposed of in accordance with chapter NR 113, Wisconsin Administrative Code. All other services, including but not limited to the servicing of effluent filters, mechanical or pressurized components, pretreatment units, and any servicing at intervals of 512 months, shall be performed by a certified POWTS Maintainer. A service report shall be provided to the local regulatory authority within 10 days of completion of any service event. GMW (4/01) I Page 2 of 2 START UP AND OPERATION For new construction, prior to use of the POWTS check treatment tankls) for the presence of painting products or other chemicals that may impede the treatment process and /or damage the dispersal cell(s). If high concentrations are detected have the contents of the tank(s) removed by a septage servicing operator prior to use. System start up shall not occur when soil conditions are frozen at the infiltrative surface. During power outages pump tanks may fill above normal highwater levels. When power is restored the excess wastewater will be discharged to the dispersal ceN(s) in one large dose, overloading the cell(s) and may result in the backup or surface discharge of effluent. To avoid this situation have the contents of the pump tank removed by a Septage Servicing Operator prior to restoring power to the effluent pump or contact a Plumber or POWTS Maintainer to assist in manually operating the pump controls to restore normal levels within the pump tank. Do not drive or park vehicles over tanks and dispersal cells. Do not drive or park over, or otherwise disturb or compact, the area within 15 feet down slope of any mound or at -grade soil absorption area. Reduction or elimination of the following from the wastewater stream may improve the performance and prolong the life of the POWTS: antibiotics; baby wipes; cigarette butts; condoms; cotton swabs; degreasers; dental floss; diapers; disinfectants; fat; foundation drain (sump pump) water; fruit and vegetable peelings; gasoline; grease; herbicides; meat scraps; medications; oil; painting products; pesticides; sanitary napkins; tampons; and water softener brine. ABANDONMENT When the POWTS fails and /or is permanently taken out of service the following steps shall be taken to insure that the system is properly and safely abandoned in compliance with chapter Comm 83.33, Wisconsin Administrative Code: • All piping to tanks and pits shall be disconnected and the abandoned pipe openings sealed. • The contents of all tanks and pits shall be removed and properly disposed of by a Septage Servicing Operator. • After pumping, all tanks and pits shall be excavated and removed or their covers removed and the void space filled with soil, gravel or another inert solid material. CONTINGENCY PLAN If the POWTS fails and cannot be repaired the following measures have been, or must be taken, to provide a code compliant replacement system: A suitable replacement area has been evaluated and may be utilized for the location of a replacement soil absorption system. The replacement area should be protected from disturbance and compaction and should not be infringed upon by required setbacks from existing and proposed structure, lot lines and wells. Failure to protect the replacement area will result in the need for a new soil and site evaluation to establish a suitable replacement area. Replacement systems must comply with the rules in effect at that time. ❑ A suitable replacement area is not available due to setback and /or soil limitations. As part of this permit, Ms. Quinn is requiring that you sign an erosion and sediment control plan prior to commencing construction, and we recommend that you work closely with her to ensure that proper erosion and sediment control measures are installed and maintained on your property throughout the duration of the construction. We have found that the following conditions have also been fulfilled: • Condition #2 has been fulfilled with a vote for approval by the Town of St. Joseph Town Board on January 6, 2005. • Condition #6 has been fulfilled with revised erosion and surface overflow plans submitted by James Filkins on December 28, 2004. Prior to commencing construction, you must fulfill the following outstanding conditions: • Per Condition #4, you must obtain a Building Permit from the Town of St. Joseph. • Per Condition #7, you must submit and have approved by the Planning and Zoning Department and Land and Water Conservation Department a revised landscaping plan that includes a mix of native trees, shrubs, and grasses endemic to the south - facing slopes in the area. Native trees should include fast - growing poplar hybrids and slower growing red oaks. They must be planted in a manner that fully screens the home as viewed from all directions during summer leaf -on conditions, and to secure the slopes from erosion. Planting must be done within 60 days of completing construction of the home and drainfield. • Per Condition #8(b), you must follow the recommendations and construction considerations in the geotechnical engineering report prepared by GME Consultants, Inc. and submitted to the County on December 4, 2004. You must ensure that all contractors working on this project have read the report and have signed a written statement verifying this. Signed statements from all contractors must be submitted to the Planning and Zoning Department prior to beginning construction. This is intended to protect the applicant's house and drainfield from slope failure and future erosion problems. An extra copy of the report is available at the Planning and Zoning Department for any contractors who would like to come in and read it. Finally, upon completion of the construction, you must ensure that the remaining conditions have been met: • Per Condition #5, the home must be earth -tone in color to blend in with the vegetation and geologic features present on the site. • Per Condition #8(a), you must record the stormwater and erosion management plans against the deed for the property. You are also responsible to provide an as -built drawing showing all permanent structures and drainage easements along with a recorded copy of the deed to the Planning and Zoning Department within 60 days of completing construction. The intent is to make the current and future owners aware of the responsibilities associated with the plans as well as the limitations incurred as a result of the plans. • Per Condition #9, you must install a monitoring port to ensure that the drywell is maintained and functioning properly. • Per Condition #10, you must submit to the Planning and Zoning Department photographs of the home and landscaping as viewed from the river within 60 days upon completion of the construction. • Per Conditions #11-12, you are responsible for compliance with all conditions of your variance approval. Any minor or major changes to your plans must be submitted for review by the Planning and Zoning Department. Please contact the Planning and Zoning Department to arrange a site visit after all erosion control measures have been put in place and prior to commencing construction. Reduction or elimination of the following from the wastewater stream may improve the performance and prolong the life of the POWTS: antibiotics; baby wipes; cigarette butts; condoms; cotton swabs; degreasers; dental floss; diapers; disinfectants; fat; foundation drain Isump pump) water; fruit and vegetable peelings; gasoline; grease; herbicides; meat scraps; medications; oil; painting products; pesticides; sanitary napkins; tampons; and water softener brine. ABANDONMENT When the POWTS fails and /or is permanently taken out of service the following steps shall be taken to insure that the system is properly and safely abandoned in compliance with chapter Comm 83.33, Wisconsin Administrative Code: • All piping to tanks and pits shall be disconnected and the abandoned pipe openings sealed. • The contents of all tanks and pits shall be removed and properly disposed of by a Septage Servicing Operator. a After pumping, all tanks and pits shall be excavated and removed or their covers removed and the void space filled with soil, gravel or another inert solid material. CONTINGENCY PLAN If the POWTS fails and cannot be repaired the following measures have been, or must be taken, to provide a code compliant replacement system: * A suitable replacement -area IVs been evaluated and may be utflized for the location of a replacemsrilt sort absorption system. The replacement area should be protected from disturbance and compaction and should not be binged upon by required setbacks from existing and proposed structure, lot lines and wells. Failure to protect the replacement area will result in the need for a new soil and site evaluation to establish a suitable replacement area. Replacement systems must comply with the rules in effect at that time. E3 suitable replacement area is not available due to setback and /or soil limitations. Barring advances in POWTS technology a holding tank may be installed as a last resort to replace the failed POWTS.
