C ROIX Z .UNTY RESOLUTION APPROVING TEXT AMENDMENTS TO THE TOWN OF HUDSON ZONING ORDINANCE CHAPTER 105-12, COMMERCIAL DISTRICT; 105-13, INDUSTRIAL DISTRICT; 105-14, COMMERCIAL/LIGHT INDUSTRIAL DISTRICT; 105-14.1 PLANNED UNIT DEVELOPMENT DISTRICT COVER MEMO TO: County Board of Supervisors FROM: Ken Witt, County Administrator Ellen Denzer, Director, Community Development DATE: April 6, 2021 AGENDA ITEM: Resolution Approving Text Amendments to the Town of Hudson Zoning Ordinance Chapter 105-12, Commercial District; 105-13, Industrial District; 105-14, Commercial/Light Industrial District; 105-14.1 Planned Unit Development District BACKGROUND INFORMATION Wisconsin Statute 60.62(3) requires that counties review and approve all amendments to town zoning ordinance text and maps prior to the amendment taking effect. The Town of Hudson, which has a town zoning ordinance, has approved text amendments that require County Board approval. In summary, the text amendments to the Town of Hudson Zoning Ordinance would require site plans within designated zoning districts to be submitted to the Town at least 15 days in advance of a Town Plan Commission or Town Board meeting at which the applicant is seeking consideration and/or approval. The current zoning code requires site plan submittals at least 10 days in advance of a Town Plan Commission or Town Board meeting. Resolution No. 14 (2021) 5T. Stat. § 60.62(3) states that in counties having a county zoning ordinance no town ordinance amendment is effective unless approved by the county board; and WHEREAS, St. Croix County has a zoning ordinance; and WHEREAS, the Community Development Committee has reviewed the proposed amendment and recommends approval. NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board of Supervisors that the amendments to the Town of Troy Zoning Ordinance described above are hereby approved. In all cases the site plan must be to scale and contain the same information as is required in § 105-12J, Procedure for site plan approval, in the Commercial District. and That § 105-14 Commercial/Light Industrial District, I. Procedure for site plan approval section as noted be repealed and replaced with: I. Procedure for site plan approval. (2) Section 105-12J(1)(a) through (g), (2), (3), (4) and (5), of the Commercial District of this Zoning Ordinance applies. and That § 1 Q5-14.1 Planned Unit Development District. I Application process section as noted be repealed and replaced with; (1) Site plan. Site plan approval must first be granted by the Plan Commission and then the Town Board prior to any permit being issued and construction commencing, Copies of the site plan with the date prepared and certified by a registered professional engineer for the State of Wisconsin must be submitted to the Town Cleric at least 15 days in advance of the Plan Commission or Town Board meeting at which the applicant is seeking approval. The site plan shall be to scale and provide the following information: (Sections (a) through (g) to remain as is.) (2) Preliminary development plan. Copies of the development plan with the date prepared must be submitted to the Town Clerk at least 15 days in advance of the Plan Commission or Town Board meeting at which the applicant is seeking approval. The development plan shall be to scale and provide the following information: (Sections (a) through 0) to remain as is.)
