PUBLIC HEARING NOTICE
The St. Croix County Planning and Zoning Committee will be conducting a public hearing on
March 9, 2010 at 8:30 a.m. at the St. Croix County Government Center, Room 1281, 1101
Carmichael Road, Hudson, Wisconsin, to consider the following petition(s):
WAIVER FROM LAND DIVISION REGULATIONS
1. APPLICANT: Tom and Melody Kanten
LOCATION: Sec. 6, T29N R16W, Town of Baldwin
ADDRESS: 110 Ave and Hwy 63, Baldwin, WI
REQUEST: Relief from the minimum lot width and the depth to width lot ratio pursuant
to sections 13.7 G.2.d and h of the St. Croix County Land Division
Ordinance.
Information on this petition may be obtained from the office of the St. Croix County Planning
and Zoning Department, Hudson, Wisconsin. In the case of cancellation of this hearing, such
notice will be announced on WIXK and WEVR Radio Stations, or call the Planning and Zoning
Department at 715- 386 -4680 before 5:00 p.m.

MINUTES
PLANNING AND ZONING COMMITTEE
MARCH 9, 2010
CALL TO ORDER: Chair Ruetz called the meeting to order at 8:32 a.m.
PRESENT: Supervisors Gene Ruetz, Sharon Norton - Bauman, Lorin Sather; Peter Post and
Steve Hermsen were absent and excused.
STAFF PRESENT: Dave Fodroczi, Kevin Grabau, Ellen Denzer, Monica Lucht, Chuck
Whiting.
GUESTS: County Board Supervisor Joseph Hurtgen, County Board Supervisor Richard "Buzz"
Marzolf, Doug Zahler, Tom Kanten, Gary & Josephine Goetz, Alice Tegrootenhuis, Tony Lind,
Deanna Lind, Julie Webster.
ADOPTION OF AGENDA: Motion by Sather, 2nd by Norton - Bauman to adopt the agenda.
Motion Carried.
CONSENT AGENDA: Motion by Sather, 2nd by Norton -Bauman to adopt the consent agenda
approving the minutes of December 2, 2009 and February 1, 2010, approving the February bill
and revenue reports, and setting the date of the next meeting for April 13, 2010, 8:30 a.m. at the
Government Center. Motion carried.
Land Division Waiver Public Hearing — Tom and Melody Kanten
Chair Ruetz opened the public hearing at 8:34 a.m. The public hearing notice was acknowledged
for the record and turned over to Blackburn.
APPLICANT: Tom and Melody Kanten
LOCATION: Sec. 6, T29N RI 6W, Town of Baldwin
ADDRESS: 110 Ave and Hwy 63, Baldwin, WI
REQUEST: Relief from the minimum lot width and the depth to width lot ratio pursuant to
sections 13.7 G.2.d and h of the St. Croix County Land Division Ordinance.
Blackburn reviewed the staff report as well as the applicant's proposal and site pictures of the
proposed waiver. The purpose of the request is to create lot number 7, that is 66 feet wide for a
portion of the lot, instead of the required 170 feet wide; and the depth to width ratio is 6 to 1
instead of the required 4 to 1. If approving the request, granting this waiver would not be
detrimental to the health safety, general welfare or aesthetics of the neighborhood. Granting this
waiver would allow the applicant to enjoy their property rights. If denying the request, the
layout of this property is not unique. This waiver request is to create more lots and is therefore
based on a financial hardship.
Chair Ruetz asked if anyone wished to speak in favor of this project. Zahler outlined the waiver
application pointing out that HWY 63 is restricted, which means the Kanten only have the one
shared access on 110 Avenue. The property is unique and when the piece was purchased to
gain access, it was allowed by the County at the time. The applicant would like to know what
options are available for reaching the minimum width requirement. Zahler indicated it meets all
the ordinance requirements for the Ag- Residential District. Kanten stated the intent is to develop

the property to fund his retirement. The property is not good Agriculture land, but it's the type
of land the Town of Baldwin would like in housing, so the access to the south was necessary.
Kanten stated he didn't realize that the 66' strip of land now became part of the lot ratio
calculations, but if there is no access than the lots cannot be divided. Kanten asked for relief
from the ordinance standards. Hurtgen, introducing himself as the District 4 Supervisor and
Chairman of the Town of Baldwin, stated he thought the property would be ideal for houses
because it isn't good for farming. Webster spoke indicating his concern is that no one builds in
the easement.
Chair Ruetz asked if anyone wished to speak in opposition to this proposal. J. Goetz spoke
stating she owns the east woods abutting the Kanten property and gives the neighbors rights to
hunt. Her concern, with houses nearby, is due to the stray bullets. G. Goetz stated his concern
with neighbors nearby would be the complaints over the noise of his farm equipment, he would
prefer there were no neighbors at all. Lind owns the property to the north of the proposed
Kanten area and asked how the land division would affect property taxes and values. Sather
indicated adjoining parcels would not be affected, only the value of the improvements to the
owners of the proposed lots.
Chair Ruetz closed the public hearing at 8:57 a.m.
Motion by Sather, 2 nd by Norton -Bauman to approve the Tom Kanten waiver request.
Discussion by Sather adding that by granting this waiver, there will be no need to buy more land
to make the lot 170 feet wide, so no additional land will be taken out of farming. It is also much
safer to have the driveway off 110 Avenue instead of Hwy 63. Motion carried.

Discussion of plats and CSMs: Blackburn reviewed the list of February and March submittals.
One major preliminary plat and three CSM applications were received in March.
Planning and Zoning Business
Amendments to Commercial and Industrial Zoning Districts: Fodroczi explained the
multiple draft copies and the color coding and how they pertain to the changes made. He stated
that staff is prepared to walk the Committee through the changes. Staff proceeded to present all
the individual public comments and how they affected changes made to the ordinance. Most
comments were generally supportive and were not asking for specific changes. In particular, one
comment was indicating changes relating to kennels, which will need to be addressed in the
future as a follow -up to these ordinance amendments due to the different districts involved.
Corporation Counsel did receive and review a copy of all the changes proposed. Additional
comments were made, which staff incorporated into the ordinance. Denzer proceeded to review
with the Committee all the changes made. Motion by Norton - Bauman, 2 nd by Sather to
recommend approval of the amendments and the adopting ordinance based on the amendments
as reviewed and revised this morning. Motion carried.
Chair Ruetz called for a break at 11:35 a.m.

The Committee reconvened at 11:44 a.m.
Review of Planning & Zoning Director Position Description: Fodroczi presented the position
description based on the creation of the position in 2005, but added some of the wording has
recently been changed by Springsted. Sather questioned if the Masters Degree is a state
requirement. Fodroczi answered that a Masters Degree in Planning is the generally available
professional degree that is commonly required for such a position. The Committee proceeded to
review the position description.
Closed Session: Motion by Norton- Bauman, 2nd by Sather to go into closed session per Wis.
Stats § 19.85(l) (c) for the purpose of the annual performance review of the Planning and Zoning
Director at 11:47 a.m. Roll call vote: All were in favor.
The meeting adjourned at 12:35 p.m.
