APPLICANT: PACRR, LLC LOCATION: Sec. 29, T31N R16W, Town of Cylon ADDRESS: 1901 Highway 46, New Richmond REQUEST: Relief from the landscape buffer requirement pursuant to section 13.7 J.5.c of the St. Croix County Land Division Ordinance. Information on this petition may be obtained from the office of the St. Croix County Planning and Zoning Department, Hudson, Wisconsin. In the case of cancellation of this hearing, such notice will be announced on WIXK and WEVR Radio Stations, or call the Planning and Zoning Department at 715- 386 -4680 before 5:00 p.m. Gene Ruetz, Chair Planning and Zoning Committee I MINUTES PLANNING AND ZONING COMMITTEE JANUARY 12, 2010 CALL TO ORDER: Chair Ruetz called the meeting to order at 8:30 a.m. PRESENT: Supervisors Gene Ruetz, Sharon Norton - Baumann, Lorin Sather; Peter Post and Steve Hermsen arrived at 8:31 a.m. STAFF PRESENT: Dave Fodroczi, Kevin Grabau, Alex Blackburn, Monica Lucht, Chuck Whiting. GUESTS: Roxanne Rummel, Allyn Gess, Cynthia Leier, Patricia Shatswell, Jon Whitcomb. ADOPTION OF AGENDA: Motion by Sather, 2nd by Norton - Baumann to adopt the agenda. Motion Carried. CONSENT AGENDA: Motion by Sather, 2 by Norton - Baumann to adopt the consent agenda approving the minutes of December 8, 2009 and approving the December bill and revenue reports. Motion carried. DATE OF NEXT MEETING: At the request of Chair Ruetz, the Committee set the date of the next meeting for February 1, 2010, 8:30 a.m. at the Government Center. Land Division Waiver Public Hearing — PACRR, LLP Chair Ruetz opened the public hearing at 8:33 a.m. The public hearing notice was acknowledged for the record and turned over to Blackburn. APPLICANT: PACRR, LLC LOCATION: Sec. 29, T31N R16W, Town of Cylon ADDRESS: 1901 Highway 46, New Richmond REQUEST: Relief from the landscape buffer requirement pursuant to section 13.7 J.5.c of the St. Croix County Land Division Ordinance. Blackburn reviewed the staff report as well as the applicant's proposal and site pictures of the proposed waiver. The purpose of the request is to create lots 1 and 2 without the required landscape screening along the entire east side and north side of lot 1. Staff could not recommend any findings to support this request to waive the landscaping standards. If denying the request to waive the landscaping standards, findings could include: This request would allow the creation of commercial lots without landscaping the perimeter. The future owner of lot 1 would then have to pay for the perimeter landscaping as well as any landscaping required by the Board of Adjustment as part of the special exception permit for the commercial use. The absence of landscaping would detract from the neighborhood aesthetics. In terms of landscaping requirements there is nothing unique about this property and fulfilling the requirements appears to be an inconvenience to the sub - divider. Chair Ruetz asked if anyone wished to speak in favor of this project. Whitcomb submitted a letter from an adjoining landowner stating that from their view a landscape buffer would not be 1 necessary. Whitcomb also stated that the Town Board of Cylon approved the proposed land division. Whitcomb feels the landscaping in this rural area, with a cost estimate exceeding $30,000, just isn't necessary. Chair Ruetz disagreed with the cost and indicated smaller trees such as spruce can be used. The ordinance allows for smaller trees if property is not located in a densely populated area. Chair Ruetz also questioned the timeline for development of the property that if plans aren't in place yet, that gives time for the trees to grow. Rummel added they would prefer not to use a Landscape Architect due to the cost. Chair Ruetz asked if anyone wished to speak in opposition to this proposal. No response. Chair Ruetz closed the public hearing at 8:50 a.m. Motion by Sather, 2 nd by Hermsen for discussion to approve the waiver request to create lots without landscape screening. Discussion. Sather and Hermsen agreed to amend the original motion to approve the waiver request with the addition of the Board of Adjustment reviewing perimeter screening at time of Special Exception permit application. Motion carried as amended. Chair Ruetz called for a break at 9:30 a.m. The Committee reconvened at 9:40 a.m. OLD AND NEW BUSINESS Land Use Ordinance Applications Municipal Plats: None Rezones to be scheduled: None Waivers to be scheduled: None Discussion of Plats and CSM's currently in the review process: Blackburn reviewed the list of December and January submittals. No applications were received in January. Code Administration Report: Grabau updated the Bettendorf non- metallic mining situation. The county wants Bettendorf to obtain a Special Exception permit for non - metallic mining, but no application has been received yet. Bettendorf has submitted a reclamation plan, however, the cost figures are off. An updated plan was then submitted but still with discrepancies. Staff met with Attorney Biegert in November and gave until December 8, 2009 to provide additional information. The date was extended by Wolski until January 15, 2010 at which time the County would file suit. Planning and Zoning Business Resolution on Rezoning Conversion Fee: Fodroczi reviewed the resolution the Committee had asked staff to draft supporting the delayed implementation of the Farmland Preservation Rezoning conversion fee. It was drafted consistent with what other counties have in the works or have already passed. It has been reviewed and revised by Corporation Counsel. Contact was made with the Department of Revenue, who provided updated data since the beginning of the program. Fodroczi asked the committee to consider the change that actual credits are now at 12 million dollars over the life of the program instead of the previously stated 5 million dollars. Motion by Norton - Baumann, 2nd by Sather to adopt the resolution with the correction in the second paragraph changed to 12 million dollars. Motion carried. 2 Comprehensive Plan: Fodroczi reviewed a letter to the Wisconsin Department of Administration requesting an adjustment in the timeframe on the Comprehensive Planning grant application to coincide with the Farmland Preservation Plan. Mike Friis, DOA Manager of Grant Administration for Comprehensive Plans will organize a conference call to work out the details. The Department of Administration has indicated through Friis that our request will be honored and we will be removed from the Regional Planning contract. A new contract will be set up to grant the extension to integrate everything with the Farmland Preservation Plan. Farmland Preservation Planning Grant Application: Fodroczi reported he submitted the grant application electronically on January 11, 2010. Details have been worked out with the Land and Water Conservation Department and the Extension office. The maximum amount of $30,000 was requested, and we will match with in -kind services of County staff time. The grant fund is eligible for any work once the contract is signed. We expect the Ag Department will move quickly and we will see a grant contract within a month and be able to charge staff time against that contract to run through the end of 2011. Pictometry Aerial Photography: Post asked to carry this over for another month. Department of Revenue County Assessment Proposal: Fodroczi reviewed the discussion from last month where the committee had asked staff to craft a letter to our legislators regarding the assessment proposal. Fodroczi suggested this should be put into a resolution form and brought through the committee. Post indicated there are sample resolutions in the Wisconsin Towns Association magazine, which can be amended to fit and passed on to legislature. Norton - Baumann stated the main drawback of the proposal is a lack of funding. Whiting indicated the rationale might be to make things, such as assessments, more consistent, and that it is important to understand the numbers and how the system works. State law already allows for the new assessing system, but it is up to each municipality. Chair Ruetz asked Post to work with Fodroczi to refine a resolution and bring to the committee in February and to County Board in March. Recycling Ordinance: Fodroczi summarized that contact has been reactivated with Attorney Bill Thiel. Thiel has indicated he could likely complete his work in January. Staff hopes to have comments and adjustments for the committee in February. Chair Ruetz stated that this will give the committee time to bring the ordinance in front of County Board in March. Possible Agenda Items for Next Meeting: Norton - Baumann would like to schedule Fodroczi's evaluation in February since this committee will disband in April.
