APPROVING THE TOWN OF ST. JOSEPH ZONING ORDINANCE

Town of St. Joseph Zoning Ordinance
BACKGROUND INFORMATION
The Town of St. Joseph is requesting County approval of the Town of St. Joseph Zoning Ordinance.
Wisconsin Statutes, §60.62(3), states that in counties having a zoning ordinance no town zoning
ordinance or amendment is effective unless approved by the county board.
The Town of St. Joseph has been under County zoning for many years and has opted to adopt their own
zoning ordinance. The Town began work on a Town Zoning Ordinance in 2019.
County staff have reviewed the current and prior versions of the zoning ordinance with regard to
consistency or conflicts with other county ordinances and state regulations. County staff provided
comments and recommendations to the Town and has addressed those comments or provided additional
information. The Town has taken appropriate steps, in accordance with Wisconsin Statutes,to establish
the authority and adopt a Comprehensive Plan for future guidance in the administration of a town zoning
ordinance. Included in the agenda packet are the following items provided by the Town of St. Joseph:
1. Resolution 2021-08 of the Town Board, dated April 27, 2021, adopting the Town Zoning Ordinance;
2. Final adopted zoning ordinance by the Town(Town of St. Joseph -Chapter 170 Zoning) dated April
27, 2021;
3. Final adopted Use Table identified by zoning district dated Apri127, 2021;
4. Final adopted Zoning Map dated April 12, 2021;
5. Minutes from meetings related to review and adoption of ordinance (from April 12, 2021 Town Plan
Commission Public Hearing,April 27, 2021 Town Board Public Hearing, and April 27, 2021 Town
Board Meeting adopting Zoning Ordinance,Zoning Map, and Use Table); and
6. Affidavits of posted public hearing notices for above meeting dates.
7. Town of St. Joseph Response to SCC 4-1-21 Review of the Town's ordinance,table and map
8. County Review Comments for the Town's ordinance,table and map 4-1-21
9. County Review Comments for Town's 2020 ordinance,table and map drafts

APPROVING THE TOWN OF ST. JOSEPH ZONING ORDINANCE
1 WHEREAS, the Town of St. Joseph adopted Village Powers on April 7, 1959 at its
2 Annual Town meeting; and
3
4 WHEREAS, the Town of St. Joseph adopted a Comprehensive Plan in accordance with
5 Wis. Stat. § 66.1001 in December of 2016; and
6
7 WHEREAS, on September 14, 2020, the Town of St. Joseph adopted a resolution
8 authorizing the St. Joseph Town Board to enact Town Zoning Ordinances; and
9
10 WHEREAS, the Town of St. Joseph conducted public hearings on working drafts of the
11 Zoning Ordinance, Zoning Map, and Use Table on September 14, 2020, November 30, 2020 and
12 January 7, 2021; and

14 WHEREAS, the St. Croix County Community Development Department reviewed said
15 public hearing drafts of the proposed Town of St. Joseph Zoning Ordinance, Zoning Map and
16 Use Table and provided comments to the Town; and
17
18 WHEREAS, on April 12, 2021 the Town of St. Joseph Plan Commission conducted a
19 public hearing and recommended approval of the revised Zoning Ordinance, Zoning Map, and
20 Use Table; and
21
22 WHEREAS, on April 27, 2021, the Town of St. Joseph Town Board conducted a public
23 hearing on the Town of St. Joseph, Chapter 170 -Zoning Ordinance, Zoning Map and Use
24 Table; and
25
26 WHEREAS, on April 27, 2021, the Town of St. Joseph Town Board approved
27 Resolution 2021-08, adopting the Town of St. Joseph Zoning Ordinance, Zoning Map and Use
28 Table and directed the Town Clerk to forward the documents to St. Croix County for approval;
29 and

31 WHEREAS, Wis. Stat. § 60.62(3), states that in counties having a county zoning
32 ordinance no town zoning ordinance or amendment is effective unless approved by the county
33 board; and

35 WHEREAS, St. Croix County has a zoning ordinance; and
36
37 WHEREAS, the Community Development Committee has reviewed the Zoning
38 Ordinance, Zoning Map and Use Table for the Town of St. Joseph.

40 NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board of
41 Supervisors that the Town of St. Joseph Zoning Ordinance, Zoning Map and Use Table, is
42 hereby approved.
