JANUARY 12, 1995
T. CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI
PRESENT: Chairperson Einar Horne; Supervisors John Mortensen, Jack Dowd, Tim Filipiak and
Daryl Standafer. Staff present included George Hayducsko, Dave Fodroczi, Greg
Timmerman, John Krizek, Troy Gansluckner and Rosemary Olson. Guests in attendance
were Tom Leiser of Coy & Associates, Craig Davis of R. W. Beck and Michele Lyksett
of the New Richmond News.
Chairperson Horne called the meeting to order at 8:10 a.m. Motion by Mortensen, seconded by Filipiak
to adopt the agenda. Motion carried. Motion by Dowd, seconded by Standafer to approve the minutes
from December, 1994. Motion carried.
Waste -to -Energy Update
c) Motion by Standafer, seconded by Mortensen to go into closed session pursuant to Wisconsin Statute
19.85(1)(g) to confer with legal counsel regarding the ARR bankruptcy. Roll call vote - all yes, motion
carried.
Motion by Dowd, seconded by Mortensen to come out of closed session pursuant to Wisconsin Statute
19.85(2). Roll call vote - all yes, motion carried.
Summary of Bills
Hayducsko referred to a handout in the packet of information sent to the Committee summarizing the bills
for December, 1994. He noted that there are two additional bills for Chairperson Home's signature and
Committee approval. Motion by Mortensen, seconded by Dowd to approve the bills with the two
additional bills signed by Chairperson Horne. Motion carried.
Hayducsko referred to a copy of the property taxes due for the Waste -to -Energy Facility in New
Richmond. Timmerman recommended that the taxes not be paid due to the fact that the County is no
longer under any obligation to perform the Service Agreement. Motion by Filipiak, seconded by Standafer
to not pay the property taxes for the Waste -to -Energy Facility in New Richmond because the County is
no longer under any obligation to perform the Service Agreement. Roll call vote - all yes, motion carried.
Haulers
b) Hayducsko reported that Stromme Sanitation did pay their past due bill with the County and were
acquired by Waste Management, Inc. He further noted that Olson Sanitation and Johnson Sanitation have
not paid and are past due 90 days or more. Corporation Counsel will go ahead with legal proceedings
against the two outstanding past due accounts as discussed at the December meeting.
a) Hayducsko reported that the department has received some applications for the 1995 hauler licenses.
Timmerman commented on the legal aspects of licensing haulers. It was noted that legally the County
cannot license the haulers under the Solid Waste Collection and Transportation Ordinance because it
requires the haulers to deliver all waste to the facility, which is impossible because ARR shut it down.
Timmerman recommended that the Committee recommend to the County Board on Tuesday that the Solid
Waste Collection & Transportation Ordinance #264(90) be repealed. He further noted that all
requirements for regulating haulers are covered by federal and state laws. Discussion on whether or not
to have a public hearing and was determined that it was not legally necessary. Motion by Filipiak,
seconded by Standafer that the County's Solid Waste collection and Transportation Ordinance be repealed
because: 1. Because of ARR's defaults under the Service Agreement, including shutting down the plant,
the waste haulers operating in St. Croix County were forced to find other places to take their solid waste;
2. Because of ARR's defaults, including shutting down the plant, the County has in force an ordinance
requiring haulers to deliver waste to the plant, which is impossible; 3. Because of ARR's defaults,
including shutting down the plant, the County is in a position of having claims filed against it by haulers
and the County must mitigate its damages. Motion carried.
Recycling
a) Fodroczi introduced Troy Gansluckner, the new Recycling Specialist and reviewed his background for
the position.
b) Hayducsko discussed the enforcement of the recycling law when we get complaints on neighbors,
tenants, haulers, etc. He explained that the first step would be to educate the people in violation and the
second step would be forfeitures in different stages. Chairperson Horne suggested that we wait until the
public has been more informed about recycling before we start fining people for non-compliance.
Waste -to -Energy Facility Update continued
a) Hayducsko referred to the handout of a letter of default sent to the County from ARR for not paying
the October, 1994 invoice. Timmerman stated that a letter was written to the bankruptcy attorney
requesting his position on whether the invoice needs to be paid and who to pay it to. Timmerman has
not received any further information on this.
b) Timmerman noted that ARR has filed an appeal with Judge Needham to reconsider his decision
regarding the standards to be applied for the dioxin emission test. A date has not been set for that
hearing.
c) Hayducsko asked the Committee for authorization to hire an engineer to review the documents
involved in the bankruptcy and to look at the facility to evaluate the possibility of rehabilitating the facility
to start operation again. The Committee agreed that Supervisor Dowd will work with staff in choosing
the engineer. Motion by Mortensen, seconded by Filipiak to authorize staff with the help of Supervisor
Dowd to hire a consultant engineer with expertise in this area for any necessary analysis of the facility.
Motion carried.
Tom Leiser of Coy &Associates explained his part in the rebuilding of the waste -to -energy facility. He
stated that his company was hired by ARR who was recommended to ARR by Prudential. His job is to
try and find a way to reopen the facility on a consultant basis.
Craig Davis of R. W. Beck explained that due to many issues caused by the lack of maintenance over the
past two years, Prudential asked them to assist in the evaluation of what could be done, how long it would
take, how much it would cost and help them make a decision as to whether or not they want to try and
save their investment. Davis and Leiser both agreed that a budget amount was set for $700,000 over a
5 month schedule to do the rehabilitation. Davis noted that he informed Prudential that there are several
letters from the DNR that no one was aware of that will effect the 5 month schedule. Davis further noted
that R. W. Beck is not taking sides with ARR or the County, but are trying to do a job.
Household Hazardous Waste Program
Krizek asked the Committee to consider a user fee for the people who use the hazardous waste program
in 1995. He believes this is a market the County can target and use it as a service for revenues for the
County.
Hayducsko reported that the results of the Clean Sweep Survey were completed and referred to a handout
with a summary and the totals. He pointed out that the majority of the people who participated would
like a program every year. Hayducsko asked the Committee to reconsider their decision to have the
program every other year. He noted that the Ag Clean Sweep is this summer at a cost of $7,000 to the
County.
Any Other Business
Hayducsko reported that he will be resigning his term as Co -Chairperson of the WCSWMA Board next
week at the conference. He referred to a letter in the packet of information from AROW asking if
Hayducsko would be interested in being on the legislative committee. After further discussion staff and
the Committee agreed that Hayducsko should concentrate on what is going on in the County with solid
waste and recycling.
The February Committee meeting was confirmed for the 9th.
Motion by Dowd, seconded by Mortensen to adjourn the meeting at 10:20 a.m. Motion carried.
