Staff finds that the proposed project meets the requirements of the St Croix Animal Waste Storage Facility Ordinance with the following findings: 1) The proposed facility is located in the Town of Forest and is proposed to house up to 499 Animal Units. The proposed facility does not require a Conditional Use Permit from the Town of Forest or St Croix county. 2) Plans for the propose facility indicate that both animal housing and animal waste structures will meet the Town of Forest setbacks from public right-of-way as per Town ordinance Section 4 (A). 3) The facility is subject to St Croix Counties Chapter 11 Animal Waste Storage Ordinance and meets the requirements of that ordinance. 4) The plans submitted for the manure storage facility included engineered plans, an operation and maintenance plan, soil logs, construction inspection plans and specifications, grading plans, and erosion control plans. A nutrient management plan (NMP) was also submitted. 5) The proposed facility is not located in a floodplain, Shoreland zoned area, or in wetlands. Based on these findings, approval of the land use permit is subject to the following conditions: 1) The applicant shall provide an as -built drawing of the constructed animal waste storage facility signed by a professional engineer. 2) The applicant shall obtain an operation permit from the county prior to use of the structure. 3) The applicant shall submit annually a certified 590 NMP with checklist by April leach year. I I P a g e 4) The applicant shall remain in full compliance with the Wisconsin Administrative Code ATCP 50 and NR 151 for animal housing and waste storage facility and the fields in the nutrient management plan. 5) Any modifications to the animal waste facility require approval of the County Code Administrator. 6) Upon transfer of ownership a written notice shall be submitted to the Code Administrator. 7) The Land Use Permit is valid for one year. A request can be made for one additional year. 8) If the operation ceases operations for a period of 24 months the animal waste storage facility shall be closed according to Chapter 11.3 of the Animal Waste Storage Facility Ordinance. 9) The owner shall give five working days notice to the Resource Management Division prior to starting construction. It is the applicant's responsibility to ensure compliance with any other local, state, or federal rules or regulations, including building permits that may be needed from the Town of Forest. REVIEW: The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete application and supporting documents, the Zoning Administrator will: • send copies of the applications to the appropriate reviewing agencies for comment. Applicants are encouraged to contact their town to discuss their application and inquire about necessary building permits and approvals at the town level; • schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project corners and label the flags accordingly, and • review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval, the permit will be mailed to the applicant or to the applicant's agent. If approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant may also be required to apply through the Town for a local building permit. All site plans, pictures, and other materials submitted with the application become the property of the Community Development Department and will remain in the file. For projects that involve land disturbance requests, the following additional information may be required: ❑ Detailed drawings (scale should not be greater than 1 inch to 200 feet). ❑ Grading plan showing grading limits and pre and post contours.
