CROIX COUNTY CODE OF ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 13 LAND DIVISION Sections 13.4 and 13.5 Ordinance No.'717 (2010) St. Croix County, Wisconsin The St. Croix County Board of Supervisors does ordain as follows: WHEREAS, 2009 Wisconsin Act 376 effective June 1, 2010 amended Chapter 236 of the Wisconsin Statutes in regards to county and local government approval and recording timeframes for final plats of land divisions; and WHEREAS, county and local governments must bring their ordinances into conformance with these changes by January 1, 2011; and WHEREAS, Chapter 13 Land Division, of the St. Croix County Code of Ordinances, is not in conformance with the amendments to Chapter 236. THEREFORE, Chapter 13 Land Division, of the St. Croix County Code of Ordinances is hereby amended as shown below, effective December 31, 2010: 13.4 A. 4. a. If the final plat is not submitted within 24 36 months of the approval of the preliminary plat, the Zoning Administrator may refuse to approve the final plat based on major land use changes affecting the plat, significant ordinance revisions or legal implications... . d. If the final plat is submitted within 24 36 months of the approval of the preliminary plat, the Zoning Administrator shall examine the final plat for conformance with the approved preliminary plat, any conditions of approval of the preliminary plat, this ordinance, and all laws, rules, regulations, comprehensive plans and comprehensive plan components which apply to it.... h. If the notice is inadvertently omitted, however, the deadlines shall still be effective... . k. The final plat (and related documents) must be recorded within 12 months after the last approval and 36 months from the first approval If the final plat and related documents are not recorded within the time frames listed above 90 days of the date ef final plat uppreval the approval is void. If the applicant fails to record and there are no changes to the final plat as approved, the Zoning Administrator may allow the applicant to resubmit the final plat upon payment of a resubmittal fee. If there are any changes to the final plat a new concept and preliminary plat application and associated fees must be submitted.... 13.5 A. 3.
