Section 17.72 Rezoning Amendments

The St. Croix County Board of Supervisors does ordain as follows:
WHEREAS, Doug Lee applied to the St. Croix County Planning and Zoning Department to rezone
approximately 1.50 acres in the NE 1 /4 of the NE 1 /a of Section 21, T29N, R16W, in the Town of
Baldwin, from Agricultural to Agricultural Residential; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the
rezoning request on March 5, 2008 in the Agricultural Service and Educational Center in Baldwin,
Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee considered all written
information and verbal testimony presented at the hearing, and made the following findings in
support of the request:
1. A recommendation for rezoning the parcel has been received from the Town of Baldwin
including statements that the request if consistent with WSS 91.77.
2. The parcel is in the rural planning area and is an appropriate use.
3. The proposed use is consistent with minimum lot size requirements in the rural planning
area.
4. The proposed non - residential use is somewhat consistent with the rural character of the
area.
5. The request is somewhat consistent with the surrounding neighborhood, countryside or
terrain.
6. The proposed use has minimal potential to adversely impact stormwater management.
7. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
8. The proposed use has minimal potential to adversely impact shoreland areas or wetlands
and closed depressions located in shoreland areas.
9. The proposed use has minimal potential to adversely impact closed depressions or
wetlands.
10. The proposed use is consistent with restricting development on slopes in excess of 20 %.
11. The proposed use is generally consistent with policies to preserve woodlands, prairie
remnants, unique open spaces, or environmental corridors.
12. The proposed use is generally consistent with the goal to protect and improve
groundwater quality to supply clean water for drinking and recharging surface waters and
wetlands.

13. The proposed use is generally consistent with the goal to protect and enhance surface
waters and wetlands to preserve their ecological functions and recreational and scenic
values.
14. The proposed use is generally consistent with the goal to protect and restore fish and
wildlife habitats for native species, improved water quality, recreational opportunities,
and natural beauty.
15. The proposed use is generally consistent or not in conflict with the St. Croix County
Natural Resources Management Plan.
16. It appears that the proposed use can comply with standards in the Land Use, Subdivision
and Sanitary ordinances.
17. The proposed use is consistent with the spirit or intent of the ordinance.
18. This rezoning approval will take effect upon legal combination of this 1.50 acre parcel
with the Town of Baldwin's 0.50 acre parcel through the County's certified survey map
process and upon filing the map with the register of deeds.
THEREFORE, the following described parcel is hereby rezoned from Agricultural to Agricultural
Residential:
Commencing at the NE Comer of said Section 21; thence S01' 10'00V 222.80' along the East line of the
NE%of said Section 21 to the point of beginning; thence continuing S01'10'00"W 50.02' along said East
line; thence N87'13'30V 401.09; thence N01 `10WE 272.82' to the North line of the NE % of said
Section 21; thence S8T13'30"E 211.33' along said North line; thence S01 "10'00"W 115.51'; thence
N877710"W 16.57 ; thence S01'10'00"W 107.25'; thence 887'13'30'E 206.33' to the East fine of said NE
% and the point of beginning, containing 65,342 square feet ( 1.50 acres ) more or less and being subject to
any easements restrictions or covenants of record.
This Amendment offered by the Planning and Zoning Committee on March 18, 2008.
