CROIX COUNTY CODE OF ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 ZONING Section 17.72 Rezoning Amendments Ordinance No. 72 C2069 St. Croix County, Wisconsin The St. Croix County Board of Supervisors does ordain as follows: WHEREAS, James and Jennifer Krueger applied to St. Croix County Planning and Zoning Department to rezone approximately 10.4 acres in the SW 1 /4 of the SW I /4 of Section 34, T29N, RI 5W, in the Town of Springfield, from Agricultural Residential to Commercial; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request on May 28, 2008 in the Agricultural Service and Educational Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee considered all written information and verbal testimony presented at the hearing, and made the following findings in support of the request: 1. The Town of Springfield has recommended approval. 2. The request is consistent with the St. Croix County Development Management Plan and the St. Croix County Natural Resources Management Plan based on: a. The parcel is in the rural planning area and is an appropriate use. b. The proposed use is consistent with minimum lot size requirements in the rural planning area. c. The proposed non - residential use is somewhat consistent with the rural character of the area and is not otherwise essential to the area d. The request is somewhat consistent with the surrounding neighborhood, countryside or terrain. e. The proposed use has some potential to adversely impact stormwater management and can be managed. f. The proposed use has some potential to adversely impact water resources with sedimentation resulting from erosion but can be managed. g. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland area but can be managed. h. The proposed use has minimal potential to adversely impact closed depressions or wetlands but can be managed. i. The proposed use is consistent with restricting development on slopes in excess of 20 %. j. The proposed use is generally consistent with policies to preserve woodlands, pT4jrie remnants, unique open spaces, or environmental corridors. k. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 1. The overall proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 3. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. 1 THEREFORE, the following described parcel is hereby rezoned from Agricultural Residential to Commercial: SEC 34 T29N R1 5W 40A SW SW EXC CSM 20 -5012 This Amendment offered by the Planning and Zoning Committee on June 17, 2008.
