CROIX COUNTY CODE OF ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 ZONING Section 17.72 Rezoning Amendments Ordinance No. 6 2oo'R) St. Croix County, Wisconsin The St. Croix County Board of Supervisors does ordain as follows: WHEREAS, Tony and Deanna Lind applied to St. Croix County Planning and Zoning Department to rezone approximately 2.354 acres in the NE '/4 of the NE '/4 of Section 06, T29N, R16W, in the Town of Baldwin, from Agricultural to Agricultural Residential; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request on July 23, 2008 in the Agricultural Service and Educational Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee considered all written information and verbal testimony presented at the hearing, and made the following findings of fact in support of the request (Items #1 -3) with two conditions (Items #4 & 5): 1. The Town of Baldwin has recommended approval and identified that the proposed use is in compliance with WSS 91.77. 2. The request is consistent with the St. Croix County Development Management Plan and the St. Croix County Natural Resources Management Plan based on: a. The parcel is in the rural planning area and is an appropriate use. b. The proposed use is consistent with minimum lot size requirements in the rural planning area. c. The request is generally consistent with the surrounding neighborhood, countryside or terrain. d. The proposed use has minimal potential to adversely impact stormwater management. e. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting from erosion. f. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. g. The proposed use has minimal potential to adversely impact closed depressions or wetlands. h. The proposed use is consistent with restricting development on slopes in excess of 20 %. i. The proposed use is generally consistent with policies to preserve woodlands, prairie remnants, unique open spaces, or environmental corridors. j. The proposed use is generally consistent with the County's policy to favor agricultural uses over non - agricultural uses when considering land use conflicts. k. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 1. The overall proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 1 AMENDMENTS TO ST. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. 4. The approximate 32.65 acre remnant parcel is to be legally combined with other property owned by applicant. The document shall contain all parcels with descriptions that are to be combined in order to show that resulting parcel will be over 35 acres and is in common ownership. 5. The 2.354 acre parcel is legally combined to the existing Lot 4 of CSM (V.23/P.5505) by County replat standards. THEREFORE, the following described parcel is hereby rezoned from Agricultural to Agricultural Residential: A PARCEL OF LAND LOCATED IN THE NE1/4 OF THE NE1 /4 OF SECTION 6, T29N, R16W, TOWN OF BALDWIN, ST. CROIX COUNTY, WISCONSIN; DESCRIBED AS FOLLOWS; COMMENCING AT THE NORTHEAST CORNER OF SAID SECTION 6; THENCE S03 °06'22 "E ALONG THE EAST LINE OF THE NE1 /4 OF SAID SECTION 6 A DISTANCE OF 1024.65 FEET TO THE NORTHEAST CORNER OF LOT 4 OF CERTIFIED SURVEY MAP RECORDED IN VOLUME 23, PAGE 5505, ST. CROIX COUNTY REGISTER OF DEEDS; THENCE ALONG THE NORTH LINE OF SAID LOT 4 S89 °40'09"W A DISTANCE OF 387.77 FEET TO THE POINT OF BEGINNING; THENCE S03 °06'22 "E A DISTANCE OF 255.30 FEET TO THE SOUTH LINE OF SAID NE1 14 OF THE NEi /4; THENCE ALONG SAID LINE S89 "40'09"W A DISTANCE OF 396.30 FEET; THENCE NO3 "06'22"W A DISTANCE OF 262.76 FEET; THENCE S89 °15'13 "E A DISTANCE OF 396.73 FEET TO THE POINT OF BEGINNING. PARCEL CONTAINS 2.354 ACRES. PARCEL IS SUBJECT TO ALL EASEMENTS, RESTRICTIONS AND COVENANTS OF RECORD. This Amendment offered by the Planning and Zoning Committee on August 19, 2008.
