CROIX COUNTY CODE OF ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 ZONING Section 17.72 Rezoning Amendments Ordinance No. - ?7(4 C2- St. Croix County, Wisconsin The St. Croix County Board of Supervisors does ordain as follows: WHEREAS, The Estate of Thomas Pietsch applied to St. Croix County Planning and Zoning Department to rezone approximately 51.9 acres in the NE '/4 of the NW '/4 and the NW ' / 4 of the NW '/4 of Section 05, T31N, R16W, in the Town of Cylon, from Agricultural to Agricultural District II; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request on July 23, 2008 in the Agricultural Service and Educational Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee considered all written information and verbal testimony presented at the hearing, and made the following findings of fact in support of the request (Items #1 -3) with one condition (Item #4): 1. A recommendation has been received from the Town of Cylon "to approve Option 2 and the enclosed map" as presented to the Town and that the request is consistent with WSS 91.77. 2. The request is consistent with the St. Croix County Development Management Plan and the St. Croix County Natural Resources Management Plan based on: a. The parcel is in the rural planning area and is an appropriate use. b. The proposed use is consistent with minimum lot size requirements in the rural planning area. c. The proposed non - residential use is consistent with the rural character of the area and is not otherwise essential to the area. d. The request is consistent with the surrounding neighborhood, countryside or terrain. e. The proposed use provides a buffer for residential development from nearby agricultural uses or non - metallic mining. f. The proposed use has minimal potential to adversely impact stormwater management. g. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting from erosion. h. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. i. The proposed use has minimal potential to adversely impact closed depressions or wetlands. j. The proposed use is consistent with restricting development on slopes in excess of 20 %. k. The proposed use is generally consistent with policies to preserve woodlands, prairie remnants, unique open spaces, or environmental corridors. 1. The proposed use is consistent with the County's policy to favor agricultural uses over non - agricultural uses when considering land use conflicts. m. The request does protect or preserve agricultural land. 1 n. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. o. The overall proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 3. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. 4. The 20.0 acre parcel (buyer: Monnot) and the 31.9 acre remnant parcel must become legal lots through the County Certified Survey Map process. THEREFORE, the following described parcel is hereby rezoned from Agricultural to Agricultural District II: SEC 5 T3 IN R16W 20.80 AC NE NW EXC S 850' OF W 1320'& EXC N 100' OF E 100'(20.8 acres); and SEC 5 T3 IN R16W 47A NW NW FRL EXC PT TO CSM 11/2978 & EXC PART TO 1373/121 (31.1 acres) This Amendment offered by the Planning and Zoning Committee on August 19, 2008.
