ST RO LINTY RESOLUTION ESTABLISHING LIBRARY LEVY
WHEREAS, Wis. Stat. § 43.12 requires that counties reimburse libraries for the cost of
serving residents living within municipalities located in the county that do not have their own
municipal library; and

WHEREAS, such residents are referred to in Wisconsin library finance terms as "rural
residents;" and

WHEREAS, the cost is determined by dividing the total operating expenditures by the
total number of circulations and then multiplying that amount by the number of actual
circulations provided to rural residents of the County who have used that municipal library; and

WHEREAS, the County, in its Plan of Library Service 2019-2022 ("Library Plan"), has
determined that it is just and proper to reimburse the libraries at no less funding than the full cost
(100%) of providing library services to rural residents; and

WHEREAS, the County retains the right under its adopted Library Plan to adjust funding
for reasons that are other than arbitrary; and

WHEREAS, the Town of Hudson and the Town of St. Joseph requested approval from
the County to join the Hudson Area Joint Library in 2002 and 2004, respectively; and

WHEREAS, there was concern that several of the neighboring municipalities with
existing libraries would lose rural circulation revenue if such approvals were granted; and

WHEREAS, it is documented in 2002, and again in 2004, that the Hudson Area Joint
Library and its participating municipalities pledged to continue to pay the neighboring libraries
in the same manner as the County had been doing so that the affected neighboring municipalities
would lose no rural circulation revenue; and

WHEREAS, the County relied on those representations in approving the participation of
the Town of Hudson and the Town of St. Joseph in the Hudson Area Joint Library in 2002 and
2004, respectively; and

WHEREAS, in 2013 the participating municipalities of the Hudson Area Joint Library
and the Board of Trustees of the Hudson Area Joint Library decided to renege on this promise;
and

WHEREAS, beginning in 2014 and continuing, Hudson Area Joint Library no longer
passes along to its neighboring libraries the share of tax revenue that had been promised; and

WHEREAS, the County is required to pay at least 70% of the cost of rural circulation by
March 1 of each year to each public library.

NOW, THEREFORE, BE IT RESOLVED that St. Croix County shall pay to the
Hudson Area Joint Library 70% of the cost of rural circulation by March 1, 2022 and shall pay
all other municipal libraries serving residents living in municipalities that do not have their own
municipal library 100% of the cost of rural circulation by March 1, 2022.

BE IT FURTHER RESOLVED that the difference between 100% and 70% of the cost
of rural circulation reimbursement to the Hudson Area Joint Library, $25,395, be distributed by
the County among those libraries within the County in proportion to how they have been
adversely affected by the Hudson Area Joint Library's breach of its original promise that was
relied upon by the County when the County granted its approval for the participation of the
Town of Hudson and Town of St. Joseph in the Hudson Area Joint Library. Said payment of this
distribution shall be made to the affected libraries by March 1, 2022.

BE IT FURTHER RESOLVED that this Resolution be reflected in the County's budget
for 2022.
