TOBACCO ON COUNTY PROPERTIES

Whereas in October, 2009 the County Board approved a resolution prohibiting the use of
tobacco on County properties; and
Whereas that action was proposed as a public health measure by the Health and Human
Services Board; and
Whereas upon approving that resolution the question was raised of whether the action as
applied to County AFSCME employees by the County violated provisions of collective
bargaining between the County and its AFSCME groups; and
Whereas concerns have been raised that the tobacco prohibition pertaining to the tobacco
use in private vehicles is onerous and unlikely to be enforced; and
Whereas the Health and Human Services Board met in February to review these concerns
as brought forward by the Finance Committee, the County Board and the AFSCME bargaining
representatives; and
Whereas the Health and Human Services Committee agreed in principle that the County
policy should be reconsidered to allow tobacco use on County grounds in designated areas to be
determined by AFSCME representatives and County human resources staff and that being a
personnel matter to be reviewed by the Finance Committee; and
Whereas the Health and Human Service Committee agreed in principle that allowing
private citizens to use tobacco products while in their personal vehicles or in designated tobacco
use areas while on County property was a reasonable allowance;
Be it therefore resolved that the Finance Committee recommends the County Board of
Supervisors approve modifying the County's tobacco use policy to allow private citizens and
employees to use tobacco products in their own personal vehicles while on County property, and
that all County employees be allowed to utilize tobacco products in agreed upon designated
tobacco use areas on County property work sites.
