HomeMy WebLinkAboutResolutions 2010 (28) RESOLUTION APPROVING RECEIPT OF ESTABLISHED RATE OF COMPENSATION FOR SHERIFF'S DEPUTY KRIS STEWART Resolution No. ,::� F (- U 1 U� St. Croix County, Wisconsin WHEREAS, on August 3, 2010, while performing his official employment duties, Deputy Kris Stewart was intentionally rammed by a fleeing drunk driver; and WHEREAS, as a result of that intentional criminal act, Deputy Stewart has been incapacitated since August 3, 2010 by significant injuries; and WHEREAS, those injuries will require surgery and /or extensive long term rehabilitation, will affect his quality of life and place a financial strain on him and his family; and WHEREAS, while Worker's Compensation benefits are available to Deputy Stewart, payments will not make up what Deputy Stewart's normal compensation would be had he not been incapacitated and he will have to use accrued PTO (personal time off) to make up the difference; and WHEREAS, Article 17 - Duty Incurred Disability - of the Bilateral Agreement between St. Croix County Law Enforcement Local 108 and St. Croix County allows the County Board to approve, upon recommendation of the Sheriff, that any employee covered by the Bilateral Agreement receive his/her established rate of compensation without deduction from accrued PTO if benefits paid to the employee under Worker's Compensation are assigned to the County; and WHEREAS, Sheriff Dennis D. Hillstead has recommended that, during his incapacity, Deputy Stewart receive his established rate of compensation, retroactive to 1 August 3, 2010, without deduction from accrued PTO and assign his Worker's Compensation benefits to St. Croix County; and WHEREAS, the recommendation was made on the basis that it is fundamentally unfair to force Deputy Stewart to use accrued PTO to supplement the Worker's Compensation payment for injuries incurred while protecting the public and enforcing the law. THEREFORE, BE IT RESOLVED by the County Board of St. Croix County that Deputy Kris Stewart receive his established rate of compensation during his incapacity, for a maximum period of 6 months, retroactive to August 3, 2010, without deduction from accrued PTO on the condition that Deputy tewart assign any Worker's Compensation benefits for the incapacity resulting from the incident of August 3, 2010 to the County.
