The drainage on lot 17 will need to be mapped, as well as the wetlands/ponds 2. Identify existing culvert(s) along Cty Rd DID (corresponds with the west drainage) 3. The "wetland" complex/pond between lots 15-16 has navigable -intermittent history and should be verified if the berm was permitted by DNR and verify if downstream drainage is still obvious 4. Set/Verify the OHWM 5. Label "pond", where applicable 6. Label "shoreland-wetlands" where applicable 7. Lots will need to have LBO's identified 8. Future driveways must be constructed outside of the setback and without disturbing any wetlands. This shall be demonstrated with the CBA. They are considered "structures" and can't be within the 75-foot setback. The driveway for Lot 16 may still work. There is a gate just west of the fence corner where the driveway would likely go. WE may have to share a driveway for Lots 14 and 15. This parcel is zoned R-1, Residential, which limits the residential density According to the base parcel, a total of 6 units are available. Please include the following zoning note: "Lot 74, 75, 76, and 77 are zoned R-7, Residential District which allows 7 principal dwelling per 70 acres Two residential units remain for lot_ while zoned as R-7 Please contact the Community Development Department for more information." Once the CSM is recorded, two density units remain and the property owner shall allocate which lots are eligible Once this is determined the note above shall be edited. 4. The pond on lot 17 and a large portion of the mapped wetland on 15/16 is navigable and should be mapped accordingly. Add OHWM, 75-foot setback and shoreland note. 5. No comment. 3. 1 think I started to have this conversation with Sarah before she went on leave. I don't understand the reason for requiring this note. Listing the zoning is fine, but choosing a lot or lots that can be further divided at this time makes no sense whatsoever. There are too make factors to contemplate and consider if a lot can be further divided, not to mention the wishes of the town that the property is located in. Stating that a lot is eligible for additional residential units is at best misleading and at worst puts the current, or future, owner at risk of being liable for damages if it turns out that It cannot be divided. A buyer Is going to look at eligibility as permission. Also, are these units transferable) If my lot is eligible for additional residential units can I sell them to my neighbor so that he can divide? 4. 1 agree that the wetland Is a navigable water. I picked a contour for the OHWM based on lidar data and aerial photography. The 75-foot setback and the shoreland note are shown on the map. 5. This wetland is manmade. The water elevation of the wetland is controlled by the top of a berm. It looks like the top of the berm is a 1148 0. The LBO would then be 1150.0 6. Please identify your concerns with regard to the existing driveways and improvements. Do you mean potential Improvements? I cannot address this if I don't know what the concerns are. I am also trying to understand the concern over the small wetland near the soil test. I don't see anything in the shoreland ordinance that prohibits putting a POWTS near a wetland. Actually, said wetland is over 200 feet away from the soil test. Obviously, It can't be In the wetland. The CDD Issues the sanitary permits and does the inspections. There shouldn't be any concerns then. 7. 1 think I can find a half -acre of CBA on lots this size. I will wait for your response. Please see the attached exhibit.
