G � St. Croix County, Wisconsin WHEREAS, on October 5, 2010, the St. Croix County Board of Supervisors adopted a "soft freeze" resolution requiring any position in which a vacancy occurs to be reviewed by the parent committee, the Administration Committee and the County Board prior to refilling; and WHEREAS, the Administration Committee is the parent committee for the position of Deputy Register in Probate in the Circuit Court and has been informed that a vacancy will occur in that position because the incumbent is retiring on December 31, 2010; and WHEREAS, the Administration Committee has reviewed the position and determined the position is necessary and there are no viable alternatives to refilling the position, and therefore recommends that the position be refilled when the vacancy occurs; and WHEREAS, the County Board has reviewed the position and agrees with the conclusions of the Administration Committee and determined that the position should be refilled when the vacancy occurs. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the position of Deputy Register in Probate in the Circuit Court be refilled when the vacancy due to retirement occurs. That position will become vacant on 1 -1 -2011 as the current Deputy Register in Probate will be retiring as of 12 -31 -2010. The Administration Committee requested a `position statement' be presented to the entire County Board for consideration at its October 26, 2010 meeting. The Circuit Court Judges and the Register in Probate request that the County Board of Supervisors, on October 26, 2010, approve the hiring of a new Deputy Register in Probate for the following reasons: • Essential to the management of the office. • The Register in Probate Office is a two person office and it is essential that there be a staff person available to the public during government center business hours. If the Deputy position were not filled, there would be significant periods of time during any week when the office would have to be locked when the Register in Probate is in court and the public could not be and would not be served during those times. • The Register and Deputy are responsible for clerking all court proceedings which involve their respective case types. It is not unusual to have at least two hearings scheduled with two different branches of Circuit Court at the same time necessitating two staff to cover. • Register in Probate is a court official and if position is not filled, office support duties will not get done. • Register in Probate has her own caseload; the Deputy Register in Probate position is essential for the Register in Probate to complete the job according to statute and case processing guidelines as determined by the Director of State Courts. • Services to the public will be reduced if not filled. • The Deputy performs the duties and responsibilities of the Register in Probate when she is unavailable. • The office is responsible for not only probate duties, but juvenile court duties as well (case types: probate, trusts, guardianships, civil commitments, adoptions, termination of parental rights, all other juvenile cases with the exception of ordinance and traffic violations). • The types of cases handled by the Register in Probate are rather specialized and unlike cases handled by other court staff. Therefore, when the Register in Probate is on vacation, at conferences or ill, it will be difficult for the office to properly serve the public. • While other court related offices (DA, Victim Witness, Clerk of Court, Child Support, etc.) have increased staff when a new Circuit Court branch has been added or for other reasons, this office has remained staffed by two (2) employees since the 1970s. • This is a single classification position that, along with the Register in Probate, continues to absorb increases in duties and responsibilities for case management and office /department management.
