CROIX COUNTY CODE OF ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 ZONING Section 17.72 Rezoning Amendments Ordinance No. St. Croix County, Wisconsin WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of TED AND BERGETTA ANDERSON on December 17, 2003, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: S24/T30/R20 Acres 40.000 PLC #24.30.20.469 Sec 24 T30N R20W NE SW S24/T30/R20 Acres 41.420 PCL# 24.30.20.472. Sec. 24, T30N R20W SE SW. Also a parcel in the NE NW of Sec. 25 Desc. As Beg N '/4 Cor Sec 25; Th S 88 Deg W Alg N Ln NW '/4 1291.94'; Th S 00 Deg W 36'; Th N 89 Deg E 1292.70' To E Ln NW '/4 SD Sec; Th N 00 Deg E Alg E Ln 59' to POB. A 4.6 acre parcel in Sec 24/T30/R20 (pcl 24.30.20.471 SW SW) beginning at the NE corner, then South 175' then West 600' then North 42.5' the West 720' then North 132.5' then East 1320' to point of beginning. This includes the house and garage but does not include the barn. Total acreage is approximately 86 +/- acres. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of rolling land used for a farm field and woods. 3. A very small portion of the site is prime farmland. 4. The whole site is environmental corridor. 5. Environmental features include: over 20 percent slopes, 12 -20 percent slopes, shorelands, wetlands and closed depressions. 6. There are two small areas with slight to severe limitations for Private Onsite Wastewater Treatment Systems (POWTS). 1 7. Surrounding land uses include a subdivision to the north and southeast, small acreages to the south and agricultural or forested land to the east and west. 8. Surrounding zoning is Ag- Residential to the north, east and south and exclusive ag to the west. 9. Potential development is about 25 three -acre lots. 10. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 11. The Town of St. Joseph has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. 12. The Ag- Residential zoning designation for 87 acres is consistent with the Town of St. Joseph Comprehensive Plan, dated 1995, amended 2003. 13. The Town motion states that the rezoning does not have an impact on woodlands or environmental features because no change in use or development is proposed at this time. The Town further states that the property is suitable for potential development in the future and potential development would not cause negative impacts to environmental features or areas. The motion further states that any impacts to environmental areas would be addressed through the town subdivision ordinance. 14. The Town also states that they have or intend to provide adequate public facilities to accommodate any potential development of the property. With the following condition: 1. The Committee requires that the applicant submit documentation that the town road is dedicated around the navigable water on site and to the quarter section line on the property or have plans professionally drawn up (i.e. a professional land surveyor) and approved by the Highway Department indicating that a dedicated road can be built to the quarter section line. THEREFORE, the described parcel is hereby rezoned from Agriculture to Ag- Residential. Offered by the Planning and Zoning Committee on March 13, 2007.
