LAND USE AND DEVELOPMENT CHAPTER 17 ZONING
Section 17.72 Rezoning Amendments

St. Croix County, Wisconsin
The St. Croix County Board of Supervisors does ordain as follows:
WHEREAS, Peter and Bridget Kling applied to St. Croix County Planning and Zoning Department
to rezone approximately 10.384 acres in the NE 1 /4 of the NW 1 /4 of Section 19, T31N, R16W; in
the Town of Cylon, from Agricultural to Agricultural District I1; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the
rezoning request on August 22, 2007 in the Agricultural Service and Educational Center in
Baldwin, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee considered all written
information and verbal testimony presented at the hearing, and made the following findings in
support of the request:
1. The Town of Cylon has recommended approval and identified that the proposed use is in
compliance with WSS 91.77.
2. The request is consistent with the County Development Management Plan and the
County Natural Resources Management Plan based on:
a. The parcel is in the rural planning area and is an appropriate use.
b. The proposed use is consistent with minimum lot size requirements in the rural
planning area.
c. The proposed non - residential use is consistent with the rural character of the area.
d. The request is consistent with the surrounding neighborhood, countryside or
terrain.
e. The proposed use has minimal potential to adversely impact stormwater
management.
f. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
g. The proposed use has minimal potential to adversely impact shoreland areas or
wetlands and closed depressions located in shoreland areas.
h. The proposed use has minimal potential to adversely impact closed depressions or
wetlands.
i. The proposed use is consistent with restricting development on slopes in excess of
20 %.
j. The proposed use is consistent with policies to preserve woodlands, prairie
remnants, unique open spaces, or environmental corridors.
k. The proposed use is consistent with the County's policy to favor agricultural uses
over non - agricultural uses when considering land use conflicts.
1. The request does protect or preserve agricultural land.
m. The proposed use is generally consistent with the goal to protect and `improve
groundwater quality to supply clean water for drinking and recharging surface
waters and wetlands.
n. The proposed use is generally consistent with the goal to protect and enhance
surface waters and wetlands to preserve their ecological functions and recreational.

and scenic values.
o. The proposed use is generally consistent with the goal to protect and restore fish
and wildlife habitats for native species, improved water quality, recreational
opportunities, and natural beauty.
p. The request is generally consistent with the goal to preserve agricultural land for
crop production, scenic values, and wildlife habitat.
q. The proposed use is generally consistent or not in conflict with the St. Croix
County Natural Resources Management Plan
3. It appears that the proposed use can comply with standards in the Land Use, Subdivision
and Sanitary ordinances.
4. The proposed use is consistent with the spirit or intent of the St. Croix County Zoning
Ordinance.
5. This rezoning approval will take effect upon legal combination of this 10.384 acre parcel
with the Emerson 10.0 acre lot to satisfy the minimum lot size requirement of 20.0 acres
in the Ag -II zoning district.
THEREFORE, the following described parcels are hereby rezoned from Agricultural to
Agricultural District II:
REZONE
A parcel of land located in part of the North 112 of the NW I/4 of Section 19, T3 IN, RI 9W, Town of
Cylon, St Croix County, Wisconsin, including the south 297.795 feet of Lot 1 and Lot 2 of a Certified
Survey Map recorded in Volume 1, Page 277 at the St Croix County Register of Deeds office; described
as follows:
Commencing at the Northwest Cotner of said Section 19; thence SOl °12'39 "E a distance of 1313.31 feet
to the south line of said north 1/2 of the NW 114; thence along said south line S8V51'33 "E a distance of
1440.26 feet to the point of beginning; thence continuing along said south line S89 °51'33 "E a distance of
507.69 feet to the west line of Lot 1 of a Certified Survey Map recorded in Volume 7, Page 1945 at said
Register of Deeds office; thence along said west line NOO °05'56 "E a distance of 33.00 feet to the
northwest corner of said Lot 1; thence along the north line of said Lot 1 S89°51'33'B a distance of
954.54 feet; thence along the east line of said Lot 2 N00 °41'00 "W a distance of 297.83 feet; thence
N89°5 1'33 "W a distance of 1462.71 feet; thence along the west line of said Lot 1 SOO°41' 16 "E a distance
of 330.83 feet to the point of beginning. Containing 10.384 acres. Subject to all easements, restrictions
and covenants of record.
