Section 17.72 Rezoning Amendments

St. Croix County, Wisconsin
The St. Croix County Board of Supervisors does ordain as follows:
WHEREAS, the Wisconsin Department of Natural Resources (DNR) applied to St. Croix County
Planning and Zoning Department to rezone approximately 0.48 acres in the NW '/4 of the NE V4 of
Section 28, T3 1N, RI 9W, in the Town of Somerset, from Conservancy to Ag- Residential; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the
rezoning request on November 28, 2007 in the St. Croix County Government Center, Hudson,
Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee considered all written
information and verbal testimony presented at the hearing, and made the following findings in
support of the request:
1. The Town of Somerset has recommended approval and identified that the proposed
use is in compliance with WSS 91.77.
2. The request is consistent with the County Development Management Plan and the
County Natural Resources Management Plan based on:
a. The parcel is in the rural planning area and is an appropriate use.
b. The proposed use is consistent with minimum lot size requirements in the rural
planning area.
c. The proposed non - residential use is consistent with the rural character of the area.
d. The request is consistent with the surrounding neighborhood, countryside or
terrain.
e. The proposed use has minimal potential to adversely impact stormwater
management.
f. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
g. The proposed use has minimal potential to adversely impact shoreland areas or
wetlands and closed depressions located in shoreland areas.
h. The proposed use has minimal potential to adversely impact closed depressions or
wetlands but can be managed.
i. The proposed use is consistent with restricting development on slopes in excess of
20 %.
j. The proposed use is consistent with policies to preserve woodlands, prairie
remnants, unique open spaces, or environmental corridors.
k. The proposed use is consistent with the goal to protect and improve groundwater
quality to supply clean water for drinking and recharging surface waters and
wetlands.
1. The proposed use is consistent with the goal to protect and enhance surface waters
and wetlands to preserve their ecological functions and recreational and scenic
values.

m. The proposed use is consistent with the goal to protect and restore fish and
wildlife habitats for native species, improved water quality, recreational
opportunities, and natural beauty.
n. The request is consistent with the goal to preserve agricultural land for crop
production, scenic values, and wildlife habitat.
o. The proposed use is generally consistent or not in conflict with the St. Croix
County Natural Resources Management Plan.
3. It appears that the proposed use can comply with standards in the Land Use, Subdivision
and Sanitary ordinances.
4. The proposed use is consistent with the spirit or intent of the St. Croix County Zoning
Ordinance.
THEREFORE, the following described parcels are hereby rezoned from Conservancy to Ag-
Residential:
REZONE PARCEL #1
A parcel of land located in the Northwest quarter of the Northeast quarter of Section 28,
Township 31 North, Range 19 West, Town of Somerset, St. Croix County, Wisconsin, more
particularly described as follows:
Commencing at the Northeast corner of said Section 28,
Thence S00 °10'27 "E, along the east line of the Northeast quarter of said Section 28,
a distance of 1320.54 feet;
Thence S89 °57'36 "W, a distance of 1334.94 feet, to the Southeast corner of the Northwest
quarter of said Northeast quarter, and east line thereof;
Thence N00 °21'22 "W, along said east line a distance of 295.00 feet, to the of beginning of the
parcel herein described:
Thence continuing N00 °21'22 "W, a distance of 125.77 feet;
Thence S89 °57'36 "W, a distance of 98.26 feet;
Thence S00 °21'22 "E, a distance of 47.87 feet;
Thence S74 °57'31 "W, a distance of 105.13 feet;
Thence S45 °44'37 "W, a distance of 72.69 feet;
Thence N89 °57'36 "E, a distance of 252.33 feet, to the point of beginning.
The described parcel contains 20,224 square feet 10 46 acres).
Said parcel is subject the easements of record and as shown.
REZONE PARCEL #2
A parcel of land located in the Northwest quarter of the Northeast quarter of Section 28,
Township 31 North, Range 19 West, Town of Somerset, St. Croix County, Wisconsin, more
particularly described as follows:
Commencing at the Northeast corner of said Section 28,
Thence S00 °10'27 "E, along the east line of the Northeast quarter of said Section 28,
a distance of 1320.54 feet;
Thence S89 °57'36 "W, a distance of 1334.94 feet, to the Southeast corner of the Northwest
quarter of said Northeast quarter, and south line thereof
Thence continuing S89 °57'36 "W, a distance of 295.00 feet, to the of beginning of the parcel herein
described:
Thence N00 °21'22 "W, a distance of 110.01 feet,
Thence SB9 °57'36 "W, a distance of 7.00 feet;
Thence S00 °21'22 "E, a distance of 110.01 feet, to said south line;
Thence N89 °57'36 "E, along said south line, a distance of 7.00 feet, to the point of beginning.
The described parcel contains 770 square feet (0.02 acres).
