ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL
ORDINANCE NO. - 111 C 266 & )
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of MARK DOYLE on June 8, 2005 in the St. Croix County Government
Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following
described land:
The NE' /4 of the NE' /4 of Section 13, T- 30N -R20W, Exc P7969B to Highway Proj
1433/118, Town of Somerset. Parcel contains 22.610 +/- acres.
Based on the following findings:
1. The existing parcel is a nonconforming agriculture parcel. Rezoning to ag- residential will
result in a conforming parcel.
2. The site is not limited for the placement of POWTS.
3. The property is not identified as productive farmland.
4. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary
ordinances.
5. The parcel is in the rural planning area and is an appropriate use.
6. The proposed use is consistent with minimum lot size requirements in the rural planning
area.
7. The request is consistent with the surrounding neighborhood, countryside or terrain.
8. The proposed use has little potential to adversely impact stormwater management.
9. The proposed use has little potential to adversely impact water resources with
sedimentation resulting from erosion.
10. The proposed use has little potential to adversely impact shoreland areas or wetlii ids and
closed depressions located in shoreland areas.
11. The proposed use has little potential to adversely impact closed depressions or wets "ands.
12. The proposed use is not in conflict with the St. Croix County Natural Resources,. "
Management Plan. "
13. The proposed use to combine the 2 severed parcels will provide more opport unity to
avoid or minimize impacts to the wetland from potential development.
14. The Town of Somerset has reviewed the rezoning and recommends approval after
considering §91.77 in making their recommendation.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 22.610 -acre parcel in the Town of Somerset is now rezoned from
Agriculture to Ag- Residential.
