CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AG- RESIDENTIAL TO COMMERCIAL REZONING LAND FROM AGRICULTURE TO COMMERCIAL ORDINANCE NO. 7a6 WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of RIVARD FAMILY TRUST/ LOWELL AND VIRGINIA RIVARD TRUSTEES on March 8, 2006 in the St. Croix County Agricultural Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77 voted to approve a rezoning of the following described land: The SW 1 /4 of the SW ' / 4, Section 7, T30N -R19W, Town of Somerset. Parcel contains 4.2037 +/- acres. (See attached) (.8 acres from Ag/Residential to Commercial; 3.40 acres from Agriculture to Commercial). Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The request is consistent with the surrounding neighborhood, countryside or terrain. 3. The proposed use has minimal potential to adversely impact stormwater management. 4. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting from erosion. 5. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. 6. The proposed use has minimal potential to adversely impact closed depressions or wetlands. 7. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique open spaces, or environmental corridors. 8. The proposed use is consistent with the County's policy to favor agricultural uses over non- agricultural uses when considering land use conflicts. 9. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. ` 12. The proposed expanded commercial use of the property is compatible with the existing commercial use. With the following condition: 1. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the landowner shall cause a certified survey map to be made of the property and filed with the register of deeds. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 144.51 +/- acre parcel in the Town of Star Prairie is now rezoned from AS Residential to Commercial.
