HomeMy WebLinkAboutOrdinance 2006 (721) a ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of VICTOR J. AND MIRA STAUT on March 8, 2006 in the St. Croix County Agricultural Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: Part of NW '/4 of the SW '/4 and in the SW ' / 4 of the SW '/4, Section 16, T- 28N -R17W, Town of Pleasant Valley. Parcel contains 44.114 +/- acres. (See attached) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The proposed use is consistent with minimum lot size requirements in the rural planning area. 3. The request is consistent with the surrounding neighborhood, countryside or terrain. 4. The proposed use has minimal potential to adversely impact stormwater management. 5. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting from erosion. 6. The proposed use has little potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. 7. The proposed use will not adversely impact closed depressions or wetlands. 8. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique open spaces, or environmental corridors. 9. The request does protect and preserve agricultural land. 10. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 11. The Town of Pleasant Valley has reviewed the rezoning and recommends approval after considering §91.77 in making their recommendation. 12. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. r With the following condition: 1. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the landowner shall cause a certified survey map to be made of the property and filed with the register of deeds. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 44.114 +/- acre parcel in the Town of Pleasant Valley is now rezoned from Agriculture to Ag- Residential.
