ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL

WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of MICHAEL J. HALLER on April 5, 2006 in the St. Croix Agricultural
Center in Baldwin, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following
described land:
The NE 1/4 of the NE 1/4, Section 32, T29N -R16W, Town of Baldwin. (See attached)
Based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. The proposed use is consistent with minimum lot size requirements in the rural planning
area.
3. The request is consistent with the surrounding neighborhood, countryside or terrain.
4. The proposed use has minimal potential to adversely impact stormwater management.
5. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
6. The proposed use has little potential to adversely impact shoreland areas or wetlands and
closed depressions located in shoreland areas.
7. The proposed use will not adversely impact closed depressions or wetlands.
8. The proposed use is consistent with policies to preserve woodlands, prairie remnants,
unique open spaces, or environmental corridors.
9. The proposed use is generally consistent or not in conflict with the St. Croix County
Natural Resources Management Plan.
10. The proposed use can comply with standards in the Zoning and Subdivision ordinances.
11. The proposed use is consistent with the spirit or intent of the ordinance (zoning, land
division, non - metallic mining, sanitary, etc.).
12. The Town of Baldwin has recommended approval and identified that the proposed use is in
compliance with WSS 91.77.
13. The request is consistent with the spirit and intent of applicable County Land Use
Ordinances.
With the following conditions:
1. Prior to approval by the County Board, the applicant must submit a soil test identifying that
a POWTS can be sighted on the property to adequately serve a residential use.
2. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned
parcel, the landowner shall cause a certified survey map to be made of the property and
filed with the register of deeds.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 4.976 +/- acre parcel in the Town of Baldwin is now rezoned from
Agriculture to Ag- Residential.

That certain parcel of land located in part of the Northeast 'h of the Northeast '/a of Section 32, Township 29
North, Range 16 West, Town of Baldwin, St Croix County, Wisconsin, more fully described as follows:
Commencing at the Northeast V4 comer of said Section 32; thence S 90 °00'00" W, (assumed bearing on the
North line of the_ Northeast 1 /4 of said Section, recorded as N 87 °07'34" W and WEST), a distance of 985.81' to
the Point of Beginning of the parcel to be herein described; thence S 02 0 38'09 " - E, 679.94'; thence
S 90 0 00'00" W, 319.04' to a point on the West line of said Northeast' /. of the Northeast %,; thence along said
West line and the extended East line of Lot 1 of that Certified Survey Map recorded in Volume 16, Page 4397 of
St Croix County Certified Survey Maps, N 02 °14'14" W, 689.07', (recorded as N 00 °38'07" E), to a point on
said North line of the Northeast' /.; thence along said North line, N 90 °00'00" E, 314.54' to the Point of
Beginning, containing 216,736 square feet or 4.976 acres, being subject to an easement for public roadway
purposes over Northerly portions of said parcel as shown on this map, and to all other easements and restrictions
of record.
