CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG -I1 ORDINANCE NO. 79 `f (2- cs &Z WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its reconunendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of ANDERSON EXCAVATING on April 5, 2006 in the St. Croix Agricultural Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A 40 -acre parcel of land located in the SW 1/4 of the NE 1/4, Section 24, T28N -Rl7W, Town of Rush River. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The proposed non - residential use is consistent with the rural character of the area and is not otherwise essential to the area. 3. The request is consistent with the surrounding neighborhood, countryside or terrain. 4. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. 5. The proposed use has minimal potential to adversely impact closed depressions or wetlands. 6. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 7. Due to the location of the environmental corridor and the extent of the existing woodlot, restoration to maintain these features upon completion of mining would support the Resource Management Plan. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 8. The proposed use is consistent with the spirit and intent of the County's Land Use ordinances. (zoning, land division, non - metallic mining, sanitary, etc.). 9. The Town of Rush River has recommended approval and identified that the proposed use is in compliance with WSS 91.77. 10. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 +/- acre parcel in the Town of Rush River is now rezoned from Agriculture to Ag -II.
