CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. 72(v WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of LARRY W. JOHNSON on January 5, 2006 in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: The NE' /4 of the NE' /4 and the SE' /4 of the NE '/4, all in Section 10, T28N -R19W, Town of Troy (see attached) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The proposed use is consistent with minimum lot size requirements in the rural planning area. 3. The request is consistent with the surrounding neighborhood, countryside or terrain. 4. The proposed us does provide a buffer for residential development from nearby agricultural uses or non - metallic mining. 5. The proposed use has little potential to adversely impact stormwater management. 6. The proposed use has little potential to adversely impact water resources with sedimentation resulting from erosion. 7. The proposed use is consistent with restricting development on slopes in excess of 20 %. 8. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 9. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 10. The proposed use is consistent with the spirit or intent of County ordinances (zoning, land division, non-metallic mining, sanitary, etc.) 11. The Town of Troy has reviewed the rezoning and recommends approval after considering §91.77 in making their recommendation. ` With the following condition: 1. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the landowner shall cause a certified survey map to be made of the property and filed with the Register of Deeds. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 32.697 +/- acre parcel in the Town of Troy is now rezoned from Agriculture to Ag- Residential.
