CHAPTER SECTION 17, REZONING

WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of Mathy Construction on May 17, 2006 in the St. Croix County Government
Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following
described land:
The SE1 /4 NW1/4 and the NW1 /4 NW1/4 Section 11, T3 IN, R17W, Town of Stanton
Based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. The proposed non - residential use is consistent with the rural character of the area and is not
otherwise essential to the area.
3. The request is consistent with the surrounding neighborhood, countryside or terrain.
4. The proposed use provides a buffer for residential development from nearby agricultural
uses or non - metallic mining.
5. The proposed use has minimal potential to adversely impact stormwater management and
can be easily managed.
6. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
7. The proposed use has minimal potential to adversely impact shoreland areas or wetlands
and closed depressions located in shoreland areas.
8. The proposed use is consistent with restricting development on slopes in excess of 20 %.
9. The proposed use is consistent with policies to preserve woodlands, prairie remnants,
unique open spaces, or environmental corridors.
10. The proposed use is generally consistent or not in conflict with the St. Croix County
Natural Resources Management Plan.
11. The proposed can comply with standards in the Land Use, Subdivision, Non - Metallic
Mining and Sanitary ordinances.
12. The proposed use is consistent with the spirit or intent of the ordinance (zoning, land
division, non - metallic mining, sanitary, etc.).
13. The Town of Stanton has recommended approval and identified that the proposed use is in
compliance with WSS 91.77.

THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the parcel identified as the 40 acres in the NW1 /4 NW 1 A of Section 11 in
the Town of Stanton is now rezoned from Agricultural to Agricultural 11; and
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the parcel identified as the 40 acres in the SETA NW I A of Section 11 in the
Town of Stanton is now rezoned from Agricultural H to Agricultural.
