CROIX COUNTY CODE OF ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 ZONING Section 17.72 Rezoning Amendments Ordinance No. ')33 L Z GG- St. Croix County, Wisconsin The St. Croix County Board of Supervisors does ordain as follows: WHEREAS, John and Georgine Schottler applied to St. Croix County Planning and Zoning Department to rezone approximately 600 acres in Sections 22, 26 and 27, T30N, R19W, Town of St. Joseph, from Agricultural to Agricultural Residential; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request on July 26, 2006 in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee considered all written information and verbal testimony presented at the hearing, and made the following findings in support of the request: 1. The Town of St. Joseph has recommended approval and identified that the proposed use is in compliance with WSS 91.77. 2. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. 3. The parcel is in the rural planning area and is an appropriate use. 4. The proposed use is consistent with minimum lot size requirernents in the rural planning area. 5. The request is consistent with the surrounding neighborhood, countryside or terrain. 6. The proposed use has a significant potential to adversely impact stormwater management that can be managed if properly designed. 7. The proposed use has a significant potential to adversely impact water resources with sedimentation resulting from erosion. Such impacts can be managed if properly designed. 8. The proposed use has a significant potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. Such impacts can be managed if properly designed. 9. The proposed use has a potential to adversely impact closed depressions or wetlands. Such impacts can be managed or avoided if properly designed. 10. The proposed use is consistent with restricting development on slopes in excess of 20 %. 11. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 12. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 1 THEREFORE, the following described parcel is hereby rezoned from Agricultural to Agricultural Residential: Description property to be rezoned: SW a, NW 4, except the West 256 feet of the North 544 feet of the NE4NWa Section 22; E4NW4; E15W4; SW45W4; NE4, except Lot 1, Vol. 7, C.S.M., page 1814, Doc. No. 425588, and except the South 10 acres of the SE WET', and except the South 16 rods of the East 80 rods of the SW4 NE4; All in Sec. 27. Together with and subject to an easement for roadway ingress and egress over part of the NE4NE4, Sec. 27 and over part of said Government Lot 5 of said Sec. 26, described as follows: .A strip of land 2 rods wide lying 5'ly of and parallel and contiguous to a line running from the NW corner of said NE4 NE4, Sec. 27, thence E. along the N. lines of said Sections 27 and 26 to a point 769.13 feet E. of the NW corner of said Sec. 26; and a strip of land 4 rods wide lying E ly of and parallel and contiguous to a line running from said point 769.13 feet E. of the NW corner of said Sec. 26, thence S. 10"38'30" E. a distance of 974.10 feet to the SW corner of said Lot "C" of certified Survey Map recorded in Vol. 2, page 553, Document No. 346761, in the office of the Register of Deeds for St. Croix County, Wisconsin; All in Sections 27 and 26, All in T30N -R19W. Subject to existing highways, easements and rights of way of record.
