Section 17.72 Rezoning Amendments

St. Croix County, Wisconsin
The St. Croix County Board of Supervisors does ordain as follows:
WHEREAS, Jerry and Maira Yang applied to St. Croix County Planning and Zoning Department
to rezone approximately 20 acres in the SW '/ of Section 28, T28N, R16W, Town of Eau Galle,
from Agricultural to Agricultural Il; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the
rezoning request on June 21, 2006 in the St. Croix County Agricultural Center in Baldwin,
Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee considered all written
information and verbal testimony presented at the hearing, and made the following findings in
support of the request:
1. The Town of Eau Galle has recommended approval.
2. The request is consistent with Wisconsin State Statute § 91.77.
3. The request is consistent with the spirit and intent of applicable County Land
Use Ordinances.
4. The parcel is in the rural planning area and is an appropriate use.
5. The proposed use is consistent with minimum lot size requirements in the
rural planning area.
6. The request is consistent with the surrounding neighborhood, countryside or
terrain.
7. The proposed use has minimal potential to adversely impact stormwater
management.
S. The proposed use has minimal potential to adversely impact water resources
with sedimentation resulting from erosion.
9. The proposed use has minimal potential to adversely impact shoreland areas
or wetlands and closed depressions located in shoreland areas.
10. The proposed use has minimal potential to adversely impact closed
depressions or wetlands.
11. The proposed use is consistent with restricting development on slopes in
excess of 20 %.
12. The proposed use is consistent with policies'to prreserve woodlands, prairie
remnants, unique open,sp4ces,,,or environmental corridors.
13. The request protects and preserves agricultural land. -
14. The proposed use is generally consistent or not in conflict with the St. Croix
County Natural Resources Management Plan; and
WHEREAS, the St. Croix County Planning and Zoning Committee places the following
condition on approval of this request.
1. Prior to the issuance of a building permit or occupancy permit for a use on the
rezoned parcel, the landowner shall cause a certified survey map to be made of the
property and filed with the register of deeds.

THEREFORE, the following described parcel is hereby rezoned from Agricultural to Agricultural
Il:
Commencing at the Southwest corner of said Section 28, as the point of beginning of the parcel
herein described:
Thence N00 °22'31 "W, along the west line of the Southwest quarter of said Section 28, a distance
of 1321.56 feet, to the Northwest corner of the Southwest quarter of said Southwest quarter and
north line thereof;
Thence S87 °01 '21 "B, along said north line, a distance of 648.12 feet;
Thence SO1 °32'59 "E, a distance of 1107.58 feet;
Thence S02'50'1 9"W, a distance of 215.19 feet, to the south line of said Southwest Quarter;
Thence N87 °01 ' 17 °W, along said south line, a distance of 658.78 feet, to the point of beginning.
The described parcel contains 871,220 square feet (20.00 acres).

Hearing date: June 21, 2006
Location: SW ' / 4 of Section 28, T28N
Address of property: 2332 10` Ave., Baldwin, WI 54002
Request: To rezone 20 acres from Agricultural to Agricultural II.
Background: Property is being rezoned to Agricultural -II to allow the sale of 20
acres for a residence.
Public Comment: There was no opposition by the public.
Town Recommendation: The Town of Eau Galle supports this rezoning request.
Planning and Zoning Committee Findings: The request was found to be
consistent with the County Development Plan, the County Natural Resources
Management Plan, and County Land Use Ordinances.
Planning and Zoning Committee Recommendation: The request was approved
on a unanimous vote. The PZ Committee recommended to forward to the County
Board for approval.
