COOPERATIVE AGREEMENT BETWEEN ST. CROIX COUNTY AND
MUNICIPALITIES WITHIN ST. CROIX COUNTY FOR THE PURCHASE OF ADA-
COMPLIANT VOTING SYSTEM AND SUPPLIES; AND APPROVING AN ADVANCE
FROM THE GENERAL FUND

WHEREAS, Congress passed the Help America Vote Act of 2002 (HAVA) to provide a
uniform system of voting throughout the United States, including providing the opportunity for
disabled voters to cast their ballots unassisted if the voter so desires; and
WHEREAS, $18,000,000 has been allocated to the State of Wisconsin as HAVA funds
for the purchase of voting systems that comply with the Americans with Disabilities Act (ADA),
with a maximum allowable expenditure for each voting system, which includes hardware and
software, and may include training, extended maintenance, and other related costs, of $6,000 per
polling place; and
WHEREAS, the Wisconsin State Elections Board has authorized local units of
government to cooperatively purchase such voting systems; and
WHEREAS, the Wisconsin State Elections Board allows counties to coordinate the
purchase and submit one consolidated funding application on behalf of the municipalities located
within the county; and
WHEREAS, expenditures for voting systems and related costs up to $6,000 per polling
place will be reimbursed by the State of Wisconsin following submission of proof of purchase
within an estimated sixty to ninety days following the request for reimbursement; and
WHEREAS, it is in the best interest of St. Croix County and municipalities within St.
Croix County to have St. Croix County arrange for the purchase, make payment, and receive
reimbursement for the voting systems and related costs, therefore alleviating the need for
separate purchases and payment by, and reimbursement to, each municipality; and
WHEREAS, there is, among other things, programming, training, and maintenance
associated with the voting systems and it would be more cost effective and efficient for all
municipalities in St. Croix County to have the same type of voting systems.
THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the St.
Croix County Clerk is authorized to enter into an agreement with interested municipalities within
St. Croix County to purchase voting systems, extended warranties (to mid 2010), training, and
start-up supplies, make payment for the voting systems, and receive reimbursement for the cost
of the voting systems.

FURTHER, be it resolved that an amount not to exceed $210,000 be advanced from the
St. Croix County General Fund to cover the cost of obtaining the voting systems and related
items.
FURTHER, be it resolved that the total amount advanced will be restored to the General
Fund when the Wisconsin State Elections Board reimburses St. Croix County for the voting
system and that any amount paid by St. Croix County and not reimbursed by the Wisconsin State
Elections Board will be paid to St. Croix County by the municipality if the municipality is found
to not be eligible for reimbursement, per the attached agreement between St. Croix County and
the municipality.
